Freedom of expression, freedom of association and access to effective means of redress could contribute, in conjunction with the efforts made by governmental authorities, to effectively combating transboundary movements of toxic and dangerous wastes and products which are detrimental to the environment, to development and to the lives and health of the persons who are victims thereof.
وإن حرية التعبير، والحق في تكوين الجمعيات، وتوفير سبل انتصاف فعالة هي كلها عوامل يمكن أن تتضافر مع الجهود التي تبذلها السلطات الحكومية من أجل المكافحة الفعالة لحركات نقل النفايات والمنتجات السمية والخطرة عبر الحدود، وهي الحركات التي تضر بالبيئة، والتنمية، وحياة وصحة ضحاياها.

125. The transfer of toxic and dangerous products and wastes across frontiers and their dumping also lead to violations of human rights, not only having regard to the risks incurred by man and his environment but also considering the observed trend to export dangerous substances produced in the North to developing countries, particularly in Africa.
٥٢١- تؤدي أيضا عمليات نقل المواد والنفايات السامة والخطرة عبر الحدود والتخلص منها إلى انتهاك حقوق الإنسان، وذلك ليس فقط في ضوء المخاطر التي يواجهها الكائن البشري وبيئته وإنما أيضا بسبب الاتجاه الذي يلاحظ والذي يتمثل في تصدير مواد خطرة ينتجها الشمال إلى البلدان النامية، ولا سيما البلدان اﻷفريقية.

4. In its resolution, the Commission urged the international community to give the necessary support to developing countries, upon their request, in their efforts to implement the provisions of existing international and regional instruments governing the transboundary movement and dumping of toxic and dangerous products and wastes in order to protect and promote the human rights to life and good health of all.
٤- وحثت اللجنة، في قرارها، المجتمع الدولي على أن يقدم الى البلدان النامية، بناء على طلبها، ما يلزم من دعم لجهودها الرامية الى تنفيذ أحكام الصكوك الدولية واﻹقليمية القائمة والناظمة لنقل المنتجات والنفايات السمية والخطرة عبر الحدود وإلقائها، بغية حماية وتعزيز حق الجميع في الحياة والصحة الجيدة.

56. The differences in domestic legislation and the costs of waste disposal in the producer countries triggered the development and proliferation of transboundary movements of toxic and dangerous wastes.
٦٥- ولقد كانت الفروقات الموجودة في التشريعات الوطنية وتكاليف التخلص من النفايات في البلدان المنتجة لتلك النفايات من اﻷسباب التي أدت في اﻷصل إلى تطور وانتشار عمليات نقل النفايات السمية والخطرة عبر الحدود.
