Decree No. AN VI-103/FP/MIJ of 1 December 1988 on the organization, rules and regulations of detention facilities in Burkina Faso stipulates that no one may be kept in detention if a release order has been issued by a competent judge, if they have served their sentence or if their detention has not been extended in accordance with statutory conditions.

78. Several pieces of legislation govern the treatment of persons deprived of their liberty. These include the Code of Criminal Procedure and its implementing legislation, Decree No. AN VI-103/FP/MIJ of 1 December 1988 on the organization, rules and regulations of detention facilities in Burkina Faso, and the Code of Military Justice.
