41. The Council of Europe Convention on the Conservation of European Wildlife and natural habitats was adopted in Bern, Switzerland, on 19 September 1979 and entered into force in 1982.
٤١ - وتم اعتماد اتفاقية مجلس أوروبا لحفظ اﻷحياء البرية والموائل الطبيعية في أوروبا، في برن، سويسرا، في ١٩ أيلول/سبتمبر ١٩٧٩ ودخلت حيز النفاذ في عام ١٩٨٢.

7. The Council of Europe informed the Secretary-General on 23 May 1995 that in view of the fact that decision 49/436 dealt with the sustainable use and conservation of marine living resources, it would be particularly taken into account in the activities aimed at the implementation of the Bern Convention of 19 September 1979 on the Conservation of European Wildlife and natural habitats.
٧ - وأبلغ مجلس أوروبا اﻷمين العام، في ٢٣ أيار/مايو ١٩٩٥، أنه نظرا الى أن المقرر ٤٩/٤٣٦ تناول الاستغلال المستدام للموارد البحرية الحية وحفظها، فإنه سيؤخذ في الاعتبار بصفة خاصة في اﻷنشطة التي تهدف الى تنفيذ اتفاقية برن المؤرخة ١٩ أيلول/سبتمبر ١٩٧٩ بشأن حفظ الحياة البرية والموائل الطبيعية اﻷوروبية.

اتفاقية حفظ الأحياء البرية والموائل الطبيعية في أوروبا، بيرن، 19 أيلول/سبتمبر 1979 (القرار الأميري رقم 11.259 الصادر في 29 نيسان/أبريل 1994).

٦٨ - وقد طبق هذا النهج على مصائد اﻷسماك على نحو غير مباشر استنادا الى اتفاقية حفظ اﻷحياء البرية والموائل الطبيعية اﻷوروبية )برن ١٩٧٩( وترد في المرفق الرابع من تلك الاتفاقية قائمة باﻷدوات غير المنتقاة المتعين حظرها وهي تشمل جميع الشباك.

19. In its response of 23 May to the Secretary-General, the Council of Europe indicated that as the provisions of General Assembly resolution 49/116 concerned the sustainable use and conservation of marine living resources, they would be particularly taken into account in the activities contributing to the implementation of the Bern Convention of 19 September 1979 on the Conservation of European Wildlife and natural habitats.
١٩ - وأشار مجلس أوروبا، في رده على اﻷمين العام بتاريخ ٢٣ أيار/مايو، إلى أنه لما كانت أحكام قرار الجمعية العامة ٤٩/١١٦ تتعلق بالاستخدام المستدام للموارد الحية البحرية وحفظها، فإنها ستؤخذ في الاعتبار بوجه خاص في اﻷنشطة التي تسهم في تنفيذ اتفاقية برن المؤرخة في ١٩ أيلول/سبتمبر ٧٩١٩ بشأن حفظ اﻷحياء البرية والموائل الطبيعية في أوروبا.

(g) Take action where necessary for the conservation of biological diversity through the in situ conservation of ecosystems and natural habitats, as well as primitive cultivars and their wild relatives, and the maintenance and recovery of viable populations of species in their natural surroundings, and implement ex situ measures, preferably in the source country.
)ز( اتخاذ اجراءات عند الاقتضاء لحفظ التنوع البيولوجي عن طريق حفظ النظم الايكولوجية والموائل الطبيعية في مواقعها، فضلا عن اﻷصناف البدائية ونسائبها غير المستأنسة، وصيانة وإنقاذ تجمعات اﻷنواع الحية القادرة على البقاء في بيئتها الطبيعية، وتنفيذ تدابير خارج اﻷماكن الطبيعية يفضﱠل أن تكون في بلد المصدر .

27. The Convention on Biological Diversity states (preamble) that " the fundamental requirement for the conservation of biological diversity is the in situ conservation of ecosystems and natural habitats and the maintenance and recovery of viable populations of species in their natural surroundings " .
٢٧ - تنص اتفاقية التنوع البيولوجي )الديباجة( على أن " الشرط اﻷساسي لحفظ التنوع البيولوجي هو حفظ النظم اﻹيكولوجية والموائل الطبيعية في مواقعها الطبيعية والمحافظة على مجموعات اﻷنواع القادرة على البقــاء والعمل على تنشيطها داخل محيطاتها الطبيعية " .

It also applies to damage to protected species and natural habitats caused by such occupational activities other than those listed in annex III, and to any imminent threat of such damage occurring by reason of any of those activities, whenever the operator has been at fault or negligent. Thus fault-based liability attaches to biodiversity damage.
كما ينطبق أيضاً على الأضرار التي تحدث للأنواع المحمية والموائل الطبيعية من جراء تلك الأنشطة المهنية بخلاف تلك الواردة في المرفق الثالث، وأي تهديد وشيك بحدوث تلك الأضرار بسبب أي من تلك الأنشطة، حيثما كان هناك تقصير أو إهمال من جانب المشغل.() وهكذا ترتبط المسؤولية المبنية على التقصير التقصير بالأضرار الناجمة للتنوع البيولوجي.
