The Special Rapporteur has examined the issue from various aspects with a view to presenting a comprehensive picture of the phenomenon of summary or arbitrary executions in the contemporary world.
ودرس المقرر الخاص المسألة من جوانب شتى بغية عرض صورة شاملة لظاهرة حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في العالم المعاصر.

1. The present report is the first report to be submitted to the General Assembly since the mandate on summary and arbitrary executions was established by the Economic and Social Council in its resolution 1982/35 of 7 May 1982.
١ - هذا التقرير هو أول تقرير يقدم الى الجمعية العامة منذ أن أنشأ المجلس الاقتصادي والاجتماعي الولاية بشأن حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في قراره ١٩٨٢/٣٥ المؤرخ ٧ أيار/مايو ١٩٨٢.

35. The case of Kudirat Abiola, senior wife of the presumed winner of the 1993 presidential elections, Chief Moshood K.O. Abiola, who was allegedly shot and killed in her car on 4 June 1996, was transmitted by the Special Rapporteur on extrajudicial, summary and arbitrary executions to the Government.
٥٣- وقد أرسل المقرر الخاص المعني بحالات اﻹعدام خارج نطاق القانون واﻹعدام التعسفي واﻹعدام دون محاكمة إلى الحكومة قضية كوديرات آبيولا الزوجة اﻷولى للزعيم موشود ك. أ. آبيولا المفترض أنه فاز بانتخابات الرئاسة في عام ٣٩٩١، والتي يدعى أنها قد أطلقت عليها النار وقتلت في سيارتها في ٤ حزيران/يونيه ٦٩٩١.

The first communication, dated 17 October 1995 following an urgent appeal transmitted by the Special Rapporteur on extrajudicial, summary and arbitrary executions, raised the concern of the Special Rapporteur over the allegation that Balabagan's original sentence of seven years' imprisonment had been overturned and replaced by the death penalty.

89. While the Special Rapporteur has received reports and specific allegations of shelling and bombardments of civilian settlements, the most consistent violation of the right to life is said to stem from the continuing summary and arbitrary executions within the border areas, resulting in the death of large numbers of innocent persons, including women, children and elderly persons.

10. Urges the Special Rapporteur to continue to draw to the attention of the United Nations High Commissioner for Human Rights such situations of extrajudicial, summary and arbitrary executions as are of particularly serious concern to him or where early action might prevent further deterioration;
١٠ - تحث المقرر الخاص على مواصلة توجيه انتباه مفوض اﻷمم المتحدة السامي لحقوق الانسان إلى حالات اﻹعدام خارج نطاق القانون واﻹعدام بإجراءات موجزة واﻹعدام التعسفي التي تثير قلقا خاصا شديدا لديه أو التى يمكن أن يحول اتخاذ اجراء مبكر بصددها دون مزيد من التردي؛

28. The Committee deplored the large number of cases of summary and arbitrary executions, enforced or involuntary disappearances, torture and arbitrary or unlawful detention committed by members of the army, security and other forces.
٨٢- وأعربت اللجنة عن أسفها إزاء العدد الضخم من حالات اﻹعدام بلا محاكمة واﻹعدام التعسفي وحالات الاختفاء القسري أو غير الطوعي وحالات التعذيب والاحتجاز التعسفي أو غير القانوني المنسوبة إلى أفراد الجيش أو قوات اﻷمن أو قوات حفظ النظام اﻷخرى.

4. Deplores the continuing violations of human rights in Myanmar, including extrajudicial and arbitrary executions, rape, torture, inhuman treatment, mass arrests, forced labour, forced relocation and denial of freedom of expression, assembly, association and movement, as reported by the Special Rapporteur;

133. In resolution 1994/87, the Commission deplored " the continuing ... enforced disappearances, summary and arbitrary executions of persons who have exercised their right to freedom of opinion and expression ... " in Zaire.
٣٣١- وقد شجبت لجنة حقوق الانسان، في قرارها رقم ٤٩٩١/٧٨، " استمرار ... حالات الاختفاء القسري، واﻹعدام بإجراءات موجزة واﻹعدام التعسفي ضد أشخاص مارسوا حقهم في حرية الرأي والتعبير ... " في زائير.

Her delegation appreciated the concern expressed by the Special Rapporteur for extrajudicial, summary or arbitrary executions with regard to the situation in El Salvador.

In a letter dated 1 September 1996, the Special Rapporteur on situations of extrajudicial summary or arbitrary executions transmitted a letter to the Government setting forth the following questions:

In that resolution, the Commission invited the Special Rapporteur to submit an interim report to the General Assembly at its fifty-first session on the situation worldwide in regard to summary or arbitrary executions and his recommendations for more effective action to combat that phenomenon.

(ii) The occurrences of cases of summary and arbitrary execution, disappearance, torture, arbitrary arrest and detention without trial of, among others, journalists, opposition politicians, human rights defenders and people who have cooperated with the United Nations mechanisms;

lynching was no longer practised in Cambodia and the allegations in the Special Representative's report were based on non-identified sources and did not specify where lynching was supposed to have occurred.

These obligations arise notably in respect of those violations recognized as criminal under either domestic or international law, such as torture and similar cruel, inhuman and degrading treatment (art. 7), summary and arbitrary killing (art. 6) and enforced disappearance (arts. 7 and 9 and, frequently, 6).

The resolution further erred by failing to recognize that the concept of extrajudicial, summary and arbitrary executions and killings was not one that was applicable during armed conflict, where there was a separate, well-developed body of law governing unlawful killing.
