استمع أعضاء مجلس الأمن إلى إحاطة من الممثل السامي بشأن البوسنة والهرسك، كارلوس وستندورب.

In this vein, I should like to refer to the view recently expressed by the High Representative, Mr. Carlos Westendorp.
وفي هذا الاتجاه أود أن أشير إلى الرأي الذي أعرب عنه منـــذ حين وجيز الممثل السامي السيد كارلوس وستندورب.

We fully support the efforts of the High Representative, Mr. Carlos Westendorp.
ونؤيد بالكامل جهود الممثل السامي السيد كارلوس وستندورب.

The decision of Mr. Westendorp to dismiss Republika Srpska President Poplašen also represents the most flagrant violation of the Dayton/Paris Agreement thus far.
ويمثل أيضا قرار السيد وستندورب عزل رئيس جمهورية صربسكا بوبلاسن أفظع انتهاك حتى اﻵن لاتفاق دايتون/باريس.

That is why the Government of the Federal Republic of Yugoslavia considers that the above-mentioned decision by Mr. Westendorp cannot have any legal effect and must be considered null and void.
ولذلك تعتبر حكومة جمهورية يوغوسلافيا الاتحادية أنه لا يمكن أن يكون لقرار السيد وستندورب المذكور أعلاه أي أثر قانوني ولا بد أن يعتبر لاغيا وباطلا.

Mr. Westendorp cited three issues in particular: the cantonal elections, the Madrid Peace Implementation Council meeting, and the signing of the Agreement on Special Relations between Bosnia and Herzegovina and Croatia.
وأشار السيد وستندورب إلى ثلاث مسائل بشكل خاص: انتخابات المقاطعات اﻹدارية، واجتماع مجلس مدريد لتنفيذ السلام، وتوقيع الاتفاق المتعلق بإقامة علاقات خاصة بين جمهورية كرواتيا والبوسنة والهرسك.

وأشار السيد وستندورب إلى ثلاث مسائل بشكل خاص: انتخابات المقاطعات اﻹدارية، واجتماع مجلس مدريد لتنفيذ السلام، وتوقيع الاتفاق المتعلق بإقامة علاقات خاصة بين جمهورية كرواتيا والبوسنة والهرسك.

By this act, Mr. Westendorp demonstrated a lack of respect and disregard for the sovereign will of the citizens of Republika Srpska, who elected their President in free and fair elections.
وبالقيام بهذا العمل، أظهر السيد وستندورب عدم احترام وتجاهل لﻹرادة السيادية لمواطني جمهورية صربسكا الذين اختاروا رئيسهم في انتخابات حرة ونزيهة.

In view of that, the Federal Government considers that such an illegal decision by Mr. Westendorp cannot have any constitutional or legal effect and has to be considered null and void.
ونظرا لذلك، ترى الحكومة الاتحادية أن ذلك القرار غير القانوني من جانب السيد وستندورب لا يمكن أن يكون له أي تأثير دستوري أو قانوني وينبغي أن يعتبر لاغيا وباطلا.

The attempt on the part of Mr. Westendorp to remove from office Nikola Poplasen, the President of Republika Srpska, by decree, is an illegitimate and unprecedented arbitrary act and represents the most gross violation so far of the letter and spirit of the Dayton/Paris agreement, the Constitution of Republika Srpska and the Constitution of Bosnia and Herzegovina.
إن محاولة السيد وستندورب تنحية نيكولا بوبلاسن، رئيس جمهورية صربسكا عن منصبه بواسطة مرسوم هي عمل غير مشروع وتعسفي غير مسبوق وتمثل أكثر الانتهاكات جسامة، حتى اﻵن، لنص وروح اتفاق ديتون/باريس ودستور جمهورية صربسكا ودستور البوسنة والهرسك.

Not a single provision from the Dayton/Paris peace agreement or the provisions of the highest legal acts of Republika Srpska and Bosnia and Herzegovina gives Mr. Westendorp the right to undertake anything in disregard of constitutional organs and institutions or to wilfully remove from office the highest office holders.
وما من حكم واحد من أحكام اتفاق ديتون/باريس للسلام ولا أي من أحكام القوانين العليا لجمهورية صربسكا والبوسنة والهرسك يعطي السيد وستندورب الحق في القيام بأي عمل في تجاهل للهيئات والمؤسسات الدستورية أو القيام عمدا بإقصاء شاغلي أرفع المناصب عن مناصبهم.

Although this is not the first unconstitutional act and violation of the Dayton/Paris agreement by Mr. Westendorp, according to its gravity and implications this act surely represents the most gross violation so far of the mandate of the High Representative, absolutely disqualifying Mr. Westendorp from carrying out this responsible duty in the future.
ورغم أن هذا العمل ليس أول عمل غير دستوري أو أول انتهاك لاتفاق ديتون/باريس من جانب السيد وستندورب، من المؤكد أن هذا العمل، تبعا لخطورته واﻵثار التي ينطوي عليها، يمثل أجسم انتهاك حتى اﻵن لولاية الممثل السامي، مما ينفي عن السيد وستندورب أهلية القيام مستقبلا بهذا الواجب المحفوف بالمسؤولية.

Resolution 1112 (1997) The Security Council, inter alia, agreed the designation of Mr. Carlos Westendorp as of 12 June 1997 High Representative in succession to Mr. Carl Bildt.
القرار ١١١٢ )١٩٩٧( المؤرخ ١٢ حزيران/يونيه ١٩٩٧ وافق مجلس اﻷمن، في جملة أمور، على تعيين السيد كارلوس وستندورب ممثلا ساميا خلفا للسيد كارل بيلدت.

617. Ms. Westendorp (Lecturer in law, Maastricht University, the Netherlands) said that the Committee had already performed sterling work on the right to housing, as manifest in its general comments no. 4 (1991) and No. 7 (1997) on the right to adequate housing (art. 11, para. 1, of the Covenant).
