The previous mandate holder, Miloon Kothari, adopted an approach stressing the indivisibility of human rights and defined the human right to adequate housing as " the right of every woman, man, youth and child to gain and sustain a safe and secure home and community in which to live in peace and dignity " (A/HRC/7/16, para. 4).

To this end, the Special Rapporteur from the outset defined the right to adequate housing as " the right of every woman, man, youth and child to gain and sustain a secure home and community in which to live in peace and dignity " (E/CN.4/2001/51, para. 8), explicitly highlighting the right in relation to women and children.

His approach has been articulated in the definition that he has developed: " The human right to adequate housing is the right of every woman, man, youth and child to gain and sustain a safe and secure home and community in which to live in peace and dignity. "

At the outset, Mr. Kothari stated that the right to adequate housing should not be understood narrowly in the physical sense, but as " the human right of every woman, man, youth and child to gain and sustain a secure home and community in which to live in peace and dignity " , and that aspects relating to discrimination and housing within the context of the indivisibility and universality of human rights were critical.

In his first report to the Commission (E/CN.4/2001/51), the Special Rapporteur called for a broad interpretation of the right to adequate housing, which he defined as " the right of every woman, man, youth and child to gain and sustain a secure home and community in which to live in peace and dignity " .
