Furthermore, on 29 January 2002, at the request by the Security Council, the UN Legal Counsel clearly established that Morocco was not the administering power of the territory, that the Madrid Agreement of 1975 dividing the territory between Morocco and Mauritania did not transfer any sovereignty to its signatories and, finally, that the status of Western Sahara, as Non-Self-Governing Territory, had not been affected by this agreement.

Nevertheless it was not exempt from the obligation to comply with the relevant international norms relating to Non-Self-Governing Territories, in particular, General Assembly resolutions 1514 (XV) and 2625 (XXV). Morocco's systematic repression of human rights constituted a serious crime which violated the status of Western Sahara as a NonSelf-Governing Territory and the right of its people to self-determination.

The Secretary-General recalled that it was six months later, during the spring of 2001, that the Personal Envoy was able to determine that Morocco as administrative power in Western Sahara was prepared to support a draft framework agreement (S/2001/613, annex I) on the status of Western Sahara which envisaged a devolution of authority to the inhabitants of the Territory with final status to be determined by a referendum five years later.
