The Government of the Kingdom of Morocco makes a reservation with regard to the provisions of this article, particularly those relating to the equality of men and women in respect of rights and responsibilities on entry into and at dissolution of marriage.

56. During the fifty-third session, the Committee reviewed the draft general recommendation on the economic consequences of marriage and its dissolution.
56 - استعرضت اللجنة خلال الدورة الثالثة والخمسين مسودة توصية عامة بشأن النتائج الاقتصادية المترتبة على الزواج وفسخه.

The Committee notes with concern that provisions of the Family Code which provide for unequal rights of women and men during marriage and its dissolution are incompatible with the Convention, and in this regard recalls that the State party ratified the Convention without reservations.
وتلاحظ اللجنة بقلق أن أحكام قانون الأسرة التي تنص على عدم تساوي الحقوق للمرأة والرجل عند الزواج وفسخه تتنافى وأحكام الاتفاقية، وتشير في هذا الصدد إلى أن الدولة الطرف قد صدقت على الاتفاقية دون تحفظات.

The Committee is further concerned about the persistence of discriminatory customary laws and practices, especially in rural areas and remote communities, with regard to, inter alia, marriage and its dissolution, inheritance and property rights.

33. The Committee urges the State party to accelerate the establishment of a family court with the authority to deal with all matters relating to marriage and its dissolution, within a concrete time frame.
33 - وتحث اللجنة الدولة الطرف على الإسراع بإنشاء محكمة للأسرة وتخويلها سلطة معالجة جميع القضايا ذات الصلة بالزواج وفسخه في إطار زمني محدد.

47. With regard to personal laws, the Muslim community had begun to call for the application of such laws to marriage and its dissolution because the relevant provisions of the Civil Code were not flexible enough to take account of Muslim beliefs and practices.

It calls upon the State party to ensure equality for women in marriage and its dissolution by giving women equal rights to property accumulated during marriage, in light of article 16 of the Convention and the Committee's general recommendation No. 21 on equality in marriage and family relations.
وتدعو الدولة الطرف إلى كفالة مساواة المرأة بالرجل في الزواج وفسخه من خلال منح النساء حقوقا متساوية مع الرجال لدى تقاسم الممتلكات التي تجمعت أثناء فترة الزواج، على ضوء المادة 16 من الاتفاقية والتوصية العامة رقم 21 للّجنة بشأن المساواة في الزواج والعلاقات الأسرية.
