6.4 As to the allegation of violation of article 7 of the Covenant, read with article 2, paragraph 3, the author recalls that no action has been taken against the chief perpetrator regarding the violations of his rights, and therefore submits that the Supreme Court judgment has no basis in law or fact and itself constitutes a denial of his right to an adequate remedy for violation of his rights.

7.9 With regard to the complaint under article 10, paragraph 1, the Committee reiterates that persons deprived of their liberty may not be subjected to any hardship or constraint other than that resulting from the deprivation of liberty and that they must be treated with humanity and respect for their dignity.

3.2 In relation to the alleged violation of article 19, paragraph 2, the author contends that the Federal Electoral Institute's denial of his request to access, once the election was over, the used, unused and spoilt ballot papers from all the polling stations set up for the 2006 presidential election violated his right to seek, receive and impart information.

8.7 Regarding the question of a violation of article 9, the Committee takes note of the author's allegations that Mohammed Lemmiz was never brought before an investigating judge so that he could challenge the legality of his detention and that no official information was given to the author or her family regarding the victim's fate.
8-7 وفيما يتعلق بادعاء انتهاك المادة 9، تحيط اللجنة علماً بمزاعم صاحبة البلاغ التي تؤكد أن محمد لميز ربما لم توجه إليه تهمة قط ولم يقدم إلى سلطة قضائية يمكنه أن يعترض أمامها على مشروعية احتجازه؛ وأنه لم تقدم أية معلومات رسمية إلى صاحبة البلاغ وإلى أسرة الضحية عن مصيره.

8.7 Regarding the complaint of a violation of article 9, the information before the Committee shows that Djamel and Mourad Chihoub were arrested by agents of the State party without a warrant, then detained incommunicado without access to defence counsel and without being informed of the grounds for their arrest or the charges against them.
