4.11 With regard to the allegation that the Tribunal exceeded its competence, the State party observes that it has no factual basis.

7.2 With respect to the claim that the State party violated article 9, paragraph 1, of the Covenant, the Committee recalls that, pursuant to this article, no one shall be subjected to arbitrary arrest or detention.

183- وفيما يتعلق بالادعاء بأن احتجاز السيد ياسودا من شأنه أن يعرض للخطر حق السيد ماتسوموتو في محاكمة عادلة وفقا لما تنص عليه الفقرة 3 من المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية، فإن السيد ماتسوموتو حصل على المشورة القانونية من محامين آخرين.

4.7 On the claim that Cabal's right to be presumed innocent was violated and Pasini's identical right is being violated, the State party submits that article 14, paragraph 2, only applies to persons facing criminal proceedings.

regarding the claim under article 7, we cannot agree with the Committee that there has not been a violation of the Covenant.

6.6 With regard to his claim under article 6, the author submits that in order for his rights under article 6 to be violated, it is not necessary to prove that he will face the death penalty.
6-6 وفيما يتعلق بالادعاء بموجب المادة 6، يزعم صاحب البلاغ أن انتهاك حقوقه بموجب المادة 6 لا يعني بالضرورة تعرّضه لعقوبة الإعدام.

8.5 With regard to the alleged violation of article 10 of the Covenant, the Committee notes that, according to the author, Ali Benhadj was subjected to physical abuse on several occasions during his detention and that he was held on death row for several months.

regarding the allegation that one of the captured Azerbaijani civilians had attacked two Armenian servicemen, the account given by the representative of Armenian differed from his Government's official statements, calling into question the credibility of the narrative.
وفيما يتعلق بالادعاء القائل بأن أحد المدنيين الأذربيجانيين المعتقلين هجم على جنديين أرمينيين، فإن السرد الذي قدمه ممثل أرمينيا يختلف عن البيانات الرسمية لحكومته، مما يشكك في مصداقية القصة.

8.5 Regarding his claim under article 14, paragraph 3 (b), the author refers to his initial argument and repeats that the alleged violation derives from the fact that he was not informed of the real factual basis of the charges against him, which were explained in detail only at the hearing.
