The requirement of prior authorization and the consequent requirement of seeking an environmental impact assessment statement would also apply in the case of any major change contemplated in the proposed activity after the granting of authorization which might transform the activity into one creating a significant risk of transboundary harm.
٥ - وشرط اﻹذن السابق وما يترتب عليه من شرط الحصول على بيان بتقييم اﻷثر البيئي ينطبقان كذلـك فــي حالـة أي تغيير جوهــري متوخى في النشاط المقترح بعد منح اﻹذن قد يحول النشاط إلى نشاط يؤدي بشكل محسوس إلى خطر وقوع ضرر عابر للحدود.

His delegation accordingly welcomed the reference in article A to " specific obligations owed to other States in that regard " , which indicated that specific treaty regimes might contain obligations of result concerning measures to prevent or minimize the risk of transboundary harm.
ولذلك فإن وفده يرحب باﻹشارة الواردة في المادة ألف إلى " التزامات محددة مترتبة نحو دول أخرى بخصوص الضرر العابر للحدود " ، التي تدل على أن نظم معاهدات معينة تتضمن التزامات بتحقيق نتيجة بشأن التدابير الرامية إلى الوقاية من وقوع ضرر عابر للحدود أو التقليل منه إلى أدنى حد.

11. In 2006, the Commission had completed its work on the liability aspects and had adopted principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities (A/61/10, para. 66).

31 - ومشاريع المبادئ المتصلة بتوزيع الخسارة في حالة وقوع ضرر عابر للحدود من جراء أنشطة خطرة تمثل خطوة إيجابية ترمي إلى تشجيع الدولة على كفالة سداد تعويض عادل ومناسب لضحايا الضرر العابر للحدود، فمشاريع المبادئ هذه قد تضمنت أفكارا تقدمية؛ وثمة أهمية لاتخاذ التدابير اللازمة لتنفيذها.

55. Turning to the draft principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities, he commented that, while draft principle 2 reflected the content of recent international treaties on the subject, it was unclear what qualified as " significant damage " and who was to decide that issue.

7. His delegation also supported the Commission's recommendation that the General Assembly should endorse by a resolution the draft principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities and urge States to take national and international action to implement them.

The adoption of the draft articles on prevention of transboundary harm from hazardous activities and the draft principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities, annexed to General Assembly resolutions 62/68 and 61/36, respectively, had attested to their status as authoritative guidance for the conduct of all States in those situations.
2 - وأردفت قائلة إن اعتماد مشاريع المواد المتعلقة بمنع الضرر العابر للحدود الناجم عن أنشطة خطرة المرفقة في قرار الجمعية العامة 62/68، ومشاريع المبادئ المتعلقة بتوزيع الخسارة في حالة وقوع ضرر عابر للحدود ناجم عن أنشطة خطرة المرفقة في قرار الجمعية العامة 61/36 يشهد بمدى أهميتها كإرشادات موثوقة لسلوك جميع البلدان في هذه الحالات.

72. Addressing the topic of international liability for injurious consequences arising out of acts not prohibited by international law (chap. V of the report), he said that, even though the Commission had decided to submit to the General Assembly a draft preamble and draft principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities, some core issues deserved further reflection.

Mr. Bühler (Austria) said that, in the light of statements by other delegations, his delegation believed that the time was not yet ripe to reach a consensus decision on the ultimate form of either the articles on prevention of transboundary harm from hazardous activities or the principles on the allocation of loss in the case of transboundary harm arising out of hazardous activities.
