1- إذا كان لدى إحدى الدول أسباب معقولة تدعو للاعتقاد بأن النشاط المزمع الاضطلاع به أو الجاري تنفيذه في إقليم الدولة المصدر دولة أخرى أو تحت ولايتها أو سيطرتها قد ينطوي على مخاطر التسبب في ضرر جسيم عابر للحدود، جاز للدولة الأولى أن تطلب من الدولة الثانية تطبيق حكم المادة 9 [10].
