203- بالنسبة للحقوق الواردة في الفقرة 1 فإن الدستور الكويتي والقوانين الكويتية قد ضمنت للأفراد تلك الحقوق، فقد نص الدستور الكويتي في المادة 162 على أن شرف القضاء ونزاهة القضاة وعدلهم أساس الملك وضمان للحقوق والحريات، كما أن حق التقاضي مكفول للناس على قدم المساواة بحكم المادة 166 من الدستور.
