21. Upon his release, Mr. Wu Mei De was accommodated by the Government in a guest house and granted the necessary visa permits to facilitate his stay.

Mr. Wu Mei De insists that he does not want to return to his home country despite the Chinese and the Maldivian Governments facilitation of all procedures for his safe return.
ويصر السيد وو ماي دي على أنه لا يرغب في العودة إلى بلده رغم ما قدمته حكومة الصين وحكومة ملديف من تسهيلات بشأن جميع الإجراءات التي تضمن سلامة عودته.

The source reports that his arrest might be linked to a court case in the Maldives in which Wu Mei De was suing a Maldivian national on grounds of alleged irregularities in a business partnership.

5. According to the communication, Wu Mei De, a Chinese national, was arrested at the beginning of November 1993 and has since been detained at Gaamadhoo prison without charge or trial.
٥- ووفقاً للبلاغ، أُلقي القبض على وو ماي دِي، وهو صيني الجنسية، في بداية شهر تشرين الثاني/نوفمبر ٣٩٩١، وما زال محتجزاً منذ ذلك الحين في سجن " غامادهو " دون اتهام أو محاكمة.

For the Working Group his detention is in contravention of articles 9 and 10 of the Universal Declaration of Human Rights and of principles 2, 4, 9, 10, 11 and 13 of the Body of Principles; for the Working Group, these are violations of international norms relating to the right to a fair trial of such gravity as to confer an arbitrary character upon the deprivation of the liberty of Wu Mei De.

6. The source alleges that this detention might have been based on the collusion between one of Mr. Wu Mei De's erstwhile employers, Mr. Mohamed Musthafa Hussain, a former Government Minister and Representative to the United Nations, and the MDNS, as he became too vocal about his work permit not being renewed for dubious reasons.
6- ويدّعي المصدر أن هذا الاحتجاز قد يكون قد تم بالتواطؤ بين أحد أرباب العمل السابقين للسيد وو ماي دي، وهو السيد محمد مصطفى حسين، وهو وزير سابق في الحكومة وممثل لدى الأمم المتحدة، ووزارة الدفاع والأمن الوطني، لأنه احتج بصوت عالٍ على عدم تجديد إذن العمل الخاص به لأسباب مريبة.

7. Upon request the Ministry of Foreign Affairs explained to his ex-wife, Ms. Zhang Lin Zheng that Mr. Wu Mei De had not invested in the country according to the procedures laid down in the investments regulations of the Maldives.
7- وبناءً على طلب زوجته السابقة، أبلغت وزارة الخارجية السيدة جانغ لين زنغ أن السيد وو ماي دي لم يستثمر في البلد حسب الإجراءات المقررة في قواعد الاستثمار في جمهورية ملديف.

8. Mr. Wu Mei De claims that five Chinese nationals had raised more than 70,000 United States dollars to set up the Shanghai Restaurant and to rent the Grace Inn.
8- ويدّعي السيد وو ماي دى أن خمسة من المواطنين الصينيين قد اشتركوا في تجميع مبلغ 000 70 دولار أمريكي لإقامة مطعم شنغهاي واستئجار فندق جريس.

Mr. Wu Mei De has also demanded from the Government of Maldives an apology; a written confirmation stating that he is an innocent person; to be compensated for all his losses, both material and nonmaterial, caused by his long imprisonment; and to investigate the case and bring those responsible to justice.
وطلب السيد وو ماي دي أيضاً من حكومة جمهورية ملديف اعتذاراً، وبياناً مكتوباً يثبت براءته، والتعويض عن خسائره، سواءً منها المادية أو غير المادية، التي تسببت فيها فترة احتجازه الطويلة، والتحقيق في القضية وإحضار المسؤولين للمثول أمام العدالة.

10. The case of Mr. Wu Mei De was already the subject matter of an urgent appeal by the former Chairperson-Rapporteur of the Working Group on Arbitrary Detention on 6 September 2006, which has remained without a reply from the Government to date.
10- وكانت قضية السيد وو ماي دي موضوع التماس عاجل إلى الحكومة من الرئيسة/المقررة السابقة للفريق العامل المعني بالاحتجاز التعسفي يوم 6 أيلول/سبتمبر 2006، ولم تردّ الحكومة على تلك المذكرة.

15. In the third part of its reply the Government confirms that Mr. Richard Wu Mei De is a Chinese national who was arrested in relation to a civil dispute arising from allegations of breach of foreign investment laws in 1991.
15- وفي الجزء الثالث من ردّ الحكومة تقر بأن السيد ريتشارد وو ماي دي هو مواطن صيني أُلقي القبض عليه بصدد نزاع مدني ناشئ عن اتهامات بانتهاك قوانين الاستثمار الأجنبي في 1991.

16. Mr. Wu Mei De was again arrested in August 1993 on public disorder charges apparently angered at the progress of the civil dispute.
16- وقالت الحكومة إن السيد وو ماي دي ألقي القبض عليه مرة أخرى في آب/أغسطس 1993 بتهم تتعلق بتعكير صفو الأمن العام، فيما يبدو بسبب غضبه إزاء عدم التقدم في النزاع المدني.

18. The Government was unable to meet these demands because Mr. Wu Mei De had never been convicted of any crime: His grievances being civil and not related to the Government; but rather he had remained in custody since his arrest under his own volition.
18- ولم يكن بوسع الحكومة تلبية تلك المطالب لأن السيد وو ماي دي لم يُحكَم عليه في أي جريمة: إذ أن القضايا التي رفعها هي قضايا مدنية وليس للحكومة دخل فيها، ولكنه بقي في الحبس منذ احتجازه بمحض إرادته.

13. In the first part the Government states that " the case of Mr. Wu Mei De should be examined in the context of the broad and deep changes in the Maldives under the new administration which are aimed at improving human rights promotion and protection for all-irrespective of nationality.
13- في الجزء الأول تذكر الحكومة أن " قضية السيد وو ماي دي يجب أن يُنظر إليها في سياق التغييرات الواسعة والعميقة التي شهدتها جمهورية ملديف تحت حكم الإدارة الجديدة والتي تهدف إلى تحسين أوضاع حقوق الإنسان وحماية الجميع بغض النظر عن جنسياتهم.

The deprivation of the liberty of Wu Mei De is arbitrary, as being in contravention of articles 9 and 10 of the Universal Declaration of Human Rights and of principles 2, 4, 9, 10, 11 and 13 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, and falls within Category III of the categories applicable to the consideration of cases submitted to the Working Group.
إن حرمان وو ماي دِي من الحرية تعسفي لكونه يخالف أحكام المادتين ٩ و٠١ من اﻹعلان العالمي لحقوق اﻹنسان والمبادئ ٢ و٤ و٩ و٠١ و١١ و٣١ من مجموعة المبادئ المتعلقة بحماية جميع اﻷشخاص الذين يتعرضون ﻷي شكل من أشكال الاحتجاز أو السجن، ويندرج في الفئة الثالثة من المبادئ الواجبة التطبيق عند النظر في القضايا المعروضة على الفريق العامل.
