4.4 With regard to the author's claim under article 24, the State party acknowledges that it has particular responsibilities in relation to minors.

4.3 With regard to the author's claim of a violation of article 14, paragraph 1, of the Covenant in respect of the dismissal of his appeal by the Constitutional Court, the Committee has carefully examined the material submitted by the author.

4.4 With respect to the author's allegation of a violation of article 9, paragraph 5, the Committee notes that after his conviction by the trial court the author was imprisoned on the basis of the sentence passed by that court.

Secondly, with regard to the author's claim that the charges against him were inconsistent, that the presentation of the facts by the police and the public prosecutor were biased, that the court only heard witnesses for the prosecution, and that the judges were obviously biased, the Committee considers that these allegations have not been sufficiently substantiated for the purposes of admissibility.

8.2 With regard to the author's claim that his rights under article 9 have been violated, the Committee notes that his detention was lawful under Dutch law, section 26 of the Aliens Act.
8-2 وفيما يتعلق بادعاء صاحب البلاغ بأن حقوقه بموجب المادة 9 قد انتُهكت، تلاحظ اللجنة أن احتجازه كان قانونياً بموجب القانون الهولندي، المادة 26 من قانون الأجانب.

4.2 With regard to the author's claim that he made a complaint to the mayor of the Town Council of Roznava, the State party contends that it is not in a position to comment, as it is not aware of the contents or form of this notice.

11.1 With regard to the author's claim under article 19 of the Covenant, the Committee observes that, in accordance with article 19 of the Covenant, any restriction on the right to freedom of expression must cumulatively meet several conditions set out in paragraph 3.

4.2 With regard to the author's claim that he was denied the right to appeal, the Committee notes that according to the information provided by the author, he initially exercised his right to appeal, but subsequently withdrew the appeal.

5.4 With regard to the author's claim related to article 14, paragraph 2, of the Covenant, the Committee notes that the author has failed to substantiate, for purposes of admissibility, his claim that he was not presumed innocent until proven guilty.
5-4 وتلاحظ اللجنة، فيما يتعلق بادعاء صاحب البلاغ المتصل بالفقرة 2 من المادة 14 من العهد، أنه عجز عن إثبات ادعائه، لأغراض المقبولية، القائل بأنه لم يعتبر بريئاً لحين ثبوت الجرم عليه.

With regard to the author's claim under article 26 of the Covenant, the Committee recalls that the application of the principle of non-discrimination in that provision is not limited to the other rights guaranteed in the Covenant and notes that the European Convention contains no comparable discrimination clause.

With regard to the author's allegation that article 14, paragraph 5, has been violated, the State party submits that the author has had his case reviewed by the Court of Appeal as well as by the Privy Council.

7.2 With regard to the author's allegation that he was subjected to arbitrary detention, the Committee has noted that the author was detained for a period of 22 months, dating from 7 February 1987, a claim that has not been contested by the State party.
7-2 وفيما يتعلق بادعاء صاحب البلاغ بأنه تعرض للاحتجاز التعسفي، فقد لاحظت اللجنة أن صاحب البلاغ احتجز لمدة 22 شهراً، اعتباراً من 7 شباط/فبراير 1987، وهو ادعاء لم تفنده الدولة الطرف.

6.3 With regard to the author's allegation under article 9, paragraph 2, of the Covenant, the Committee concluded that the author had been aware of the grounds for his arrest.
6-3 وفيما يتعلق بادعاء صاحب البلاغ المقدم في إطار الفقرة 2 من المادة 9 من العهد، خلصت اللجنة إلى أن صاحب البلاغ كان على علم بأسباب توقيفه.

7.2 With respect to the author's allegation that he was subjected to arbitrary arrest or detention in violation of article 9, paragraph 1 of the Covenant, the Committee recalls that deprivation of liberty is permissible only when occurring on such grounds and in accordance with such procedures as are established by law.
7-2 وفيما يتعلق بادعاء صاحب البلاغ أنه تعرض للاعتقال أو الاحتجاز التعسفيين انتهاكاً للفقرة 1 من المادة 9 من العهد، تذكر اللجنة أنه لا يجوز حرمان أحد من حريته إلا لأسباب ينص عليها القانون وطبقاً للإجراءات المقررة فيه.

4.4 With respect to the author's claim of a violation of article 14 of the Covenant, the Committee notes that the information provided by the author does not substantiate for purposes of admissibility, the author's claim that he is a victim of a violation of article 14 of the Covenant.
4-4 وفيما يتعلق بادعاء صاحب البلاغ بحدوث انتهاك للمادة 14من العهد، تلاحظ اللجنة أن المعلومات التي قدمها صاحب البلاغ لا تدعم، لأغراض مقبولية البلاغ، ادعاءه بأنه كان ضحية لانتهاك المادة 14 من العهد.

With regard to the author's claims under article 14 it is further submitted that they are incompatible with the Covenant, and that the claim is inadmissible under article 3 of the Optional Protocol for that reason.

4.26 As regards the claim of the effects to his health due to his questioning in the hospital in June 2005, the State party reiterates, with reference to its previous submission, that the author's rights under article 10, paragraph 1, of the Covenant were not violated.
4-26 وفيما يتعلق بادعاء صاحب البلاغ أن صحته تأثرت نتيجة استجوابه في المستشفى في حزيران/يونيه 2005، تشير الدولة الطرف إلى ملاحظاتها السابقة وتكرر أن حقوق صاحب البلاغ بموجب الفقرة 1 من المادة 10 من العهد لم تُنتهك.

6.2 With reference to the author's allegation that the national authorities did not deal with his claim of non-objectivity of the tests, the State party argues that the Ministry of Justice responded to this objection on 22 December 1993.
6-2 وفيما يتعلق بادعاء صاحب البلاغ أن السلطات الوطنية لم تتعامل مع ادعاء عدم موضوعية اختبارات الشخصية، تدفع الدولة الطرف بالقول بأن وزارة العدل ردّت على هذا الادعاء في 22 كانون الأول/ديسمبر 1993.

4.16 With reference to the complainant's claim that because of his former membership of the Christian Democrats or the Lebanese Forces, he is at a `high risk'of being tortured by the authorities, the State party acknowledges that Lebanon remains beset by ongoing political instability.
4-16 وفيما يتعلق بادعاء صاحب البلاغ أن هناك احتمالاً " كبيراً " لتعرضه للتعذيب من قبل السلطات بسبب عضويته السابقة في الحزب المسيحي الديمقراطي أو القوات اللبنانية، فإن الدولة الطرف تعترف بأن لبنان لا يزال يعاني من عدم الاستقرار السياسي الدائم.

5.4 In respect of the author's claim under article 15, which had not been submitted to the European Commission of Human Rights, the Committee notes that the author was found guilty of a number of offences under the French Code of Public Health as well as under the Customs Code.
٥-٤ وفيما يتعلق بادعاء صاحب البلاغ بموجب المادة ١٥ الذي لم يعرض على اللجنة اﻷوروبية لحقوق اﻹنسان، فإن اللجنة المعنية بحقوق اﻹنسان تلاحظ أن صاحب البلاغ وجد مذنبا في عدد من الجرائم بموجب القانون الفرنسي الخاص بالصحة العامة باﻹضافة إلى قانون الجمارك.

On the alleged lack of fair trial, the State party notes that no criminal charges were brought against the author after his return, nor did he stand trial there.
وفيما يتعلق بادعاء صاحب البلاغ أنه لم يحصل على محاكمة عادلة، تلاحظ الدولة الطرف أن صاحب البلاغ لم توجَّه إليه أية تُهم جنائية بعد عودته إلى بلده، كما أنه لم يحاكَم هناك.
