77. Furthermore, the Working Group recalls that international human rights law provides for a number of rights specific to persons deprived of their liberty on the ground of suspicion that they were involved in an offence.

Finally, the Working Group recalls the Human Rights Council's request that States take into account the Group's views and, where necessary, take appropriate steps to remedy the situation of persons arbitrarily deprived of their liberty.

In conclusion, the Working Group recalls the critical findings, and its own opinions, on human rights violations occurring in Ethiopia by United Nations human rights bodies and the African Commission on Human and Peoples' Rights.
43- وفي الختام، يذكّر الفريق العامل بالاستنتاجات الناقدة. وبآرائه الخاصة، بشأن انتهاكات حقوق الإنسان في إثيوبيا من جانب هيئات الأمم المتحدة المعنية بحقوق الإنسان واللجنة الأفريقية لحقوق الإنسان والشعوب.

58. Concerning the charge of defamation pursuant to article 391 of the Penal Code, which was upheld by the Supreme Court in the case of Ms. Uwimana, the Working Group recalls that the ability to criticize public officials and, in particular, Heads of State or representatives of the Government, is an inherent component of the right to freedom of expression and opinion.

37. Regarding the question of violation of national legislation as referred to by the Government, the Working Group recalls that in its previous opinions relating to Viet Nam, it had underlined that:

In this regard, the Working Group recalls the statements and observations of the Human Rights Committee, including its general comment No. 29 (2001) on derogation during a state of emergency and its concluding observations on reports submitted by Israel (CCPR/C/79/Add.93 and CCPR/CO/78/ISR).
24- وفي هذا الصدد، يذكّر الفريق العامل ببيانات اللجنة المعنية بحقوق الإنسان وملاحظاتها، بما في ذلك تعليقها العام رقم 29(2001) بشأن عدم التقيد بأحكام العهد أثناء حالات الطوارئ، وملاحظاتها الختامية بشأن التقارير المقدمة من إسرائيل (الوثيقتان CCPR/C/79/Add.93 وCCPR/CO/78/ISR).

the Working Group recalls that, pursuant to article 9, paragraph 1, of the Convention on the Rights of the Child, a child may be separated from his or her parents against their will, when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child.
31- يذكّر الفريق العامل بأنه عملاً بأحكام الفقرة 1 من المادة 9 من اتفاقية حقوق الطفل لا يجوز فصل طفل عن والديه على كره منهما، إلا عندما تقرر السلطات المختصة، رهناً بإجراء إعادة نظر قضائية، وفقاً للقوانين والإجراءات المعمول بها، أن هذا الفصل ضروري لصون مصالح الطفل الفضلى.

Furthermore, with respect to customary international law, the Working Group recalls that, under certain circumstances, the widespread or systematic imprisonment or other severe deprivation of liberty in violations of fundamental rules of international law may constitute crimes against humanity.

During its visit, the Working Group also learned about numerous round-up operations where the police would detain foreigners and members of the Roma community who are Greek citizens and release them soon after without charge. In this regard, the Working Group recalls that any detention on discriminatory grounds constitutes arbitrary detention, and furthermore, that detention without any legal basis also renders the detention arbitrary.
وقد نما إلى علم الفريق العامل، أثناء زيارته، أنباء عن حدوث عدة عمليات اعتقال حيث يجري احتجاز الأجانب وأفراد جماعة الروما وهم من المواطنين اليونانيين ثم يجري الإفراج عنهم بُعيد ذلك دون أن توجّه إليهم تهم. وفي هذا الصدد، يذكّر الفريق العامل بأن أي عملية احتجاز تستند إلى أسباب تمييزية تشكل احتجازاً تعسفياً. وعلاوة على ذلك فإن الاحتجاز الذي لا يستند إلى أساس قانوني يجعل من ذلك الاحتجاز أمراً تعسفياً.

In this regard, the Working Group recalls that article 19, paragraph 2, of the International Covenant on Civil and Political Rights guarantees the right to freedom of expression, including artistic expression and protects all forms of expression, including audio-visual expression.
45- وفي هذا الصدد، يذكّر الفريق العامل بأن الفقرة 2 من المادة 19 من العهد الدولي الخاص بالحقوق المدنية والسياسية تكفل لكل إنسان الحق في حرية التعبير، بما في ذلك حرية التعبير الفني() وتحمي جميع أشكال التعبير، بما في ذلك التعبير السمعي والبصري.

In this respect, the Working Group recalls article 13, paragraph 3, of the Declaration, according to which " steps shall be taken to ensure that all involved in the investigation, including the complainant, counsel, witnesses and those conducting the investigation, are protected against ill-treatment, intimidation or reprisal " .

the Working Group recalls that provisions of article 14 of the International Covenant on Civil and Political Rights on the right to a fair trial are applicable where sanctions, because of their purpose, character or severity, must be regarded as penal even if, under domestic law, the detention is qualified as administrative.
20- يذكّر الفريق العامل بأن أحكام المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية المتعلقة بالحق في محاكمة عادلة تنطبق إذا كانت العقوبات جنائية نظراً لغرضها أو طبيعتها أو صرامتها وإن اعتبر الاحتجاز إدارياً بموجب القانون المحلي().

In this regard, the Working Group recalls that in another Opinion concerning the People's Republic of China it emphasized that, although national laws might punish such conduct, it is, however, protected by the rights to freedom of opinion and expression and association in international law.
وفي هذا الصدد، يذكّر الفريق العامل بأنه أكد في رأي آخر بشأن جمهورية الصين الشعبية، إلى أنه على الرغم من أن القوانين الوطنية قد تعاقب على مثل هذا التصرف، فإنه مع ذلك يحظى بالحماية بموجب الحق في حرية الرأي والحق في حرية التعبير بموجب القانون الدولي().

Finally, the Working Group recalls that in 2012 the African Commission on Human and Peoples' Rights adopted a resolution on Ethiopia, stating it was " [g]ravely alarmed by the arrests and prosecutions of journalists and political opposition members, charged with terrorism and other offences including treason, for exercising their peaceful and legitimate rights to freedom of expression and freedom of association " .
36- وأخيراً، يذكّر الفريق العامل بأن اللجنة الأفريقية لحقوق الإنسان والشعوب قد اعتمدت في عام 2012 قراراً بشأن إثيوبيا، وأفادت فيه بأنها " قد جزعت جزعاً شديداً لعمليات التوقيف والمحاكمات التي طالت صحفيين ومعارضين سياسيين اتهموا بالإرهاب وبجرائم أخرى بما فيها الخيانة، لإعمالهم حقوقهم السلمية والمشروعة في حرية التعبير وحرية تكوين الجمعيات " ().

425. the Working Group reminds the Government of its obligations under article 13, paragraph 3, of the Declaration to take steps to ensure that all persons involved in the investigation of an enforced disappearance, including the complainant, counsel, witnesses and those conducting the investigation, are protected against ill-treatment, intimidation or reprisal.
425- يذكّر الفريق العامل الحكومة بالتزاماتها بموجب الفقرة 3 من المادة 13من الإعلان بأن تتخذ خطوات تكفل لجميع المشاركين في التحقيق في حالة من حالات الاختفاء القسري، بمن فيهم صاحب الشكوى والمحامي والشهود ومن يقومون بالتحقيق، الحماية من سوء المعاملة أو التهديد أو الانتقام.
