بل ينبغي للدول الأطراف أن تبلغ اللجنة بما تتخذه من تدابير تشريعية وإدارية وقضائية وغيرها من التدابير لمنع أفعال التعذيب والمعاملة القاسية واللاإنسانية والمهينة في أي أراض خاضعة لولايتها، وللمعاقبة عليها.

9- وبالإشارة إلى تعليق اللجنة العام رقم 2(2002) على دور مؤسسات حقوق الإنسان الوطنية المستقلة في تعزيز وحماية حقوق الإنسان، ينبغي للدول الأطراف أن تبلغ اللجنة بما إذا كانت هناك مؤسسة وطنية مستقلة لحقوق الإنسان، وعند الاقتضاء، توفير معلومات عن ولايتها والدور الذي تقوم به لرصد تنفيذ البروتوكول الاختياري.
