My observations on matters, which in my opinion should be brought to the attention of the Member States, are set out in the paragraphs below.

However, the arbitral tribunal may issue an interim measure of protection confirming, extending or modifying the preliminary order, after the party against whom the preliminary order is directed has been given notice and an opportunity to present its case. "
بيد أنه يجوز لهيئة التحكيم أن تصدر تدبير حماية مؤقتا يؤكّد الأمر الأولي أو يمدّده أو يعدّلـه بعد أن يكون قد تم إرسال إخطار إلى الطرف الذي يُوجّه الأمر الأولي ضده، وأُتيحت له فرصة لكي يعرض قضيته. "

“(4)(a) Unless otherwise agreed, the arbitral tribunal may grant an interim measure of protection without notice to the party against whom the measure is directed or before the party against whom the measure is directed has had an opportunity to respond provided that:

In particular, migrant workers with potential protection needs shall not be brought to the attention of the said authorities without their knowledge and consent.
وبصفة خاصة، لا يُوجّه انتباه السلطات المذكورة إلى العمال المهاجرين الذين يمكن أن تكون لديهم احتياجات في مجال الحماية دون علمهم وموافقتهم.
