43 - ورغم أن التشريعات الداخلية في هذه الدول تنص على جريمة التعذيب إلا أنها معرفة في كثير من الأحيان تعريفا يشوبه القصور (أي أنها غير معرفة وفقا للمادة 1)، وتمانع السلطات، رغم ما لها من سلطة إجراء التحقيقات من تلقاء نفسها، في إجراء التحقيقات الجنائية في ادعاءات التعذيب؛ وهناك القليل من القرائن، هذا إن وجدت أصلا، تدل على إدانة أي مسؤول من الشرطة بارتكاب هذه الجريمة.
