" 2. Notwithstanding paragraph 1 of this article, an arbitration agreement in a transport document or electronic transport record to which this Convention applies by reason of the application of article 7 is subject to this chapter unless such a transport document or electronic transport record:

A carrier acts in " good faith " when issuing a transport document or an electronic record if
(ب) يكون الناقل قد تصرف بحسن نية لدى اصدار مستند النقل أو السجل الالكتروني اذا

(a) a transport document or an electronic transport record is prima facie evidence of the carrier's receipt of the goods as stated in the contract particulars;
(أ) يعتبر مستند النقل أو سجل النقل الإلكتروني دليلا ظاهرا على تسلم الناقل البضائع حسبما هو مبين في تفاصيل العقـد؛

The burden of proving whether a carrier acted in good faith when issuing a transport document or an electronic record is on the party claiming that the carrier did not act in good faith.
(ج) يقع عبء اثبات ما اذا كان الناقل قد تصرف بحسن نية لدى إصداره مستند النقل أو السجل الالكتروني على الطرف المدعي بأن الناقل لم يتصرف بحسن نية.

2. Notwithstanding paragraph 1 of this article, an arbitration agreement in a transport document or electronic transport record to which this Convention applies by reason of the application of article 7 is subject to this Chapter unless such an arbitration agreement:
۲- بصرف النظر عن الفقرة ١ من هذه المادة، يكون اتفاق التحكيم الوارد في مستند نقل أو سجل نقل إلكتروني تنطبق عليه هذه الاتفاقية بسبب انطباق المادة ٧ خاضعا لهذا الفصل ما لم يكن اتفاق التحكيم ذاك:

The view is that article 47 should be deleted, as it conflicts with Egyptian law, which provides that it cannot be agreed not to issue a transport document or electronic transport record.
ونرى بالتالي أن تُحذف المادة 47 لتعارضها مع القانون المصري الذي يقضي بعدم جواز الاتفاق على عدم إصدار مستند نقل أو سجل نقل إلكتروني.
