The Committee notes in this respect the author's claim that the very next day after Abdelkrim and Abdessamad Azizi's arrest she made enquiries at the Cité de la Montagne police station in Bourouba, at the Algiers central police station, at El Harrach prison and at Serkadji prison, without success.
وتلاحظ اللجنة في هذا الصدد أن صاحبة البلاغ لجأت في الصباح الذي تلى توقيف عبد الكريم وعبد الصمد عزيزي إلى مركز شرطة في حي الجبل في بوروبة ومركز الشرطة المركزي في الجزائر العاصمة وسجن الحرّاش وسجن سركاجي من دون التوصل إلى نتيجة.

Although the author repeatedly contacted the competent authorities about the disappearance of her husband and her son, the State party failed to conduct a thorough or in-depth investigation into the disappearance of Abdelkrim and Abdessamad Azizi, despite the fact that serious allegations of enforced disappearance were involved.
والحال أن صاحبة البلاغ أخطرت السلطات المختصة عدة مرات باختفاء زوجها وابنها إلا أن الدولة الطرف لم تجر أي تحقيق شامل ودقيق في اختفاء عبد الكريم وعبد الصمد عزيزي رغم أن الأمر يتعلق بادعاءات خطيرة متصلة باختفاء قسري.

The Committee finds a separate violation of article 7 of the Covenant with respect to Abdelkrim and Abdessamad Azizi and the author.
وتخلص اللجنة إلى انتهاك الدولة للمادة 7 من العهد في حق عبد الكريم وعبد الصمد عزيزي وصاحبة البلاغ().

In view of their incommunicado detention and in the absence of information provided by the State party in that regard, the Committee finds a violation of article 10, paragraph 1, of the Covenant with respect to Abdelkrim and Abdessamad Azizi.

In the present case, the Committee notes that the authorities of the State party have not provided any information to the family about the fate or whereabouts of Abdelkrim and Abdessamad Azizi since their arrest, despite the many requests to various authorities of the State party.
وفي القضية قيد البحث، تلاحظ اللجنة أن الدولة الطرف لم تقدم أية معلومات للعائلة عن مصير عبد الكريم وعبد الصمد عزيزي منذ توقيفهما ولا عن مكان وجودهما، وذلك على الرغم من الطلبات العديدة الموجهة إلى سلطات مختلفة في الدولة الطرف.

The Committee concludes that Abdelkrim and Abdessamad Azizi's enforced disappearance since 22 September 1994 denied them the protection of the law and deprived them of their right to recognition as persons before the law, in violation of article 16 of the Covenant.
وتستنتج اللجنة بناءً على ذلك أن اختفاء عبد الكريم وعبد الصمد عزيزي قسراً منذ 22 أيلول/سبتمبر 1994 حرمهما من حماية القانون ومن حقهما في الاعتراف بشخصيتهما القانونية، وفي ذلك انتهاك للمادة 16 من العهد.
