In the discharge of its mandate, the Working Group refers to the relevant international standards set forth in the Universal Declaration of Human Rights and the relevant international instruments accepted by the States concerned, in particular the International Covenant on Civil and Political Rights, as well as, when appropriate, the following standards:

When the complete or partial nonobservance of the international standards relating to a fair trial set forth in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned is of such gravity as to confer on the deprivation of liberty, of whatever kind, an arbitrary character (category III).
' 3 ' عندما يكون عدم الامتثال، الكلي أو الجزئي، للمعايير الدولية المتصلة بالحق في محاكمة عادلة، وهي المعايير المحددة في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يُضفي على الحرمان من الحرية، أياً كان نوعه، طابعاً تعسفياً (الفئة الثالثة).

Bearing in mind that, in accordance with resolution 1991/42, the task of the Working Group on Arbitrary Detention is to investigate cases of detention imposed arbitrarily or otherwise inconsistently with the relevant international standards set forth in the Universal Declaration of Human Rights, or in the relevant international legal instruments accepted by the States concerned,
وإذ تضع في اعتبارها أن مهمة الفريق العامل المعني باﻹحتجاز التعسفي ، وفقا للقرار ١٩٩١/٢٤، هي التحقيق في حالات الاحتجاز المفروض تعسفا أو بطريقة أخرى تتنافى مع المعايير الدولية ذات الصلة والمبيّنة في اﻹعلان العالمي لحقوق اﻹنسان أو في الصكوك القانونية الدولية ذات الصلة التي قبلتها الدول المعنية،

entrusted with the task of investigating cases of deprivation of liberty imposed arbitrarily, provided that no final decision has been taken in such cases by domestic courts in conformity with domestic law, with the relevant international standards set forth in the Universal Declaration of Human Rights and with the relevant international instruments accepted by the States concerned.
مكلفين بالتحقيق في حالات الحرمان من الحرية المفروضة تعسفاً، حيثما تكون السلطات القضائية الوطنية لم تتخذ أي قرار نهائي في هذه الحالات طبقاً للتشريع الوطني وللقواعد الدولية ذات الصلة المنصوص عليها في الإعلان العالمي لحقوق الإنسان وللصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية.

In the light of the foregoing, the source considers that the non-observance of the international norms relating to the right to a fair trial, as spelled out in the Universal Declaration on Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to render Mr. Rajab's deprivation of liberty arbitrary.
وفي ضوء ما تقدم، يرى المصدر أن عدم التقيّد بالقواعد الدولية المتعلقة بالحق في محاكمة عادلة، على النحو المحدد في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يضفي على حرمان السيد رجب من الحرية طابعاً تعسفياً.

ثالثاً- عندما يصل عدم الامتثال الجزئي أو الكلي للمعايير الدولية ذات الصلة، المحددة في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية والمتعلقة بالحق في محاكمة عادلة، إلى درجة من الخطورة تضفي على الحرمان من الحرية، أيّا كان نوعه، طابعا تعسفياً )الفئة الثالثة(.

ثالثا- إذا كان عدم الاحترام التام أو الجزئي للقواعد الدولية المتصلة بالحق في محاكمة عادلة، المنصوص عليها في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على الحرمان من الحرية، أيا كان شكله، طابعا تعسفيا )الفئة الثالثة(.

ثالثاً- إذا كان عدم الاحترام التام أو الجزئي للمعايير الدولية المتصلة بالحق في محاكمة عادلة، المنصوص عليها في اﻹعلان العالمي لحقوق اﻹنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على الحرمان من الحرية، أيا كان شكله، طابعاً تعسفياً )الفئة الثالثة(.

(ج) إذا كان عدم التقيد ًكليا أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial established in the Universal Declaration of Human Rights and in the relevant international instruments that have been accepted by the States concerned is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

For the same reason, the Committee considers that the opt-out clause contained in paragraph 2 would be inconsistent with the obligations accepted by the States parties who have voluntarily accepted to be parties to any of these three instruments.
وللسبب نفسه، ترى اللجنة أن البند المتعلق باختيار عدم الاعتراف باختصاص اللجنة المنصوص عليه في الفقرة 2 لن يتسق مع الالتزامات التي قبلت بها الدول الأطراف التي انضمت بصفة طوعية إلى أي صك من هذه الصكوك الثلاثة.
