ولعل التقييد المذكور أعلاه للعلاقة بين فعل الدولة وتوصية المنظمة يفيد في هذا الصدد.

1. The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو مجموعة من اﻷشخاص لا يعمل لحساب هذه الدولة.

The conduct of a person or entity which is not an organ of the State under article 4 but which is empowered by the law of that State to exercise elements of the governmental authority shall be considered an act of the State under international law, provided the person or entity is acting in that capacity in the particular instance.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو كيان لا يشكل جهازا من أجهزة الدولة بمقتضى المادة 4 ولكن يخوله قانون تلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية، بشرط أن يكون الشخص أو الكيان قد تصرف بهذه الصفة في الحالة المعينة.

Excess of authority or contravention of instructions The conduct of an organ of a State or of a person or entity empowered to exercise elements of the governmental authority shall be considered an act of the State under international law if the organ, person or entity acts in that capacity, even if it exceeds its authority or contravenes instructions.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزتها أو شخص أو كيان مخول صلاحية ممارسة بعض اختصاصات السلطة الحكومية إذا كان الجهاز أو الشخص أو الكيان يتصرف بهذه الصفة، حتى ولو تجاوز حدود سلطته أو خالف التعليمات.

We would note, however, that draft article 11 applies the converse rule to article 8: “The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.” This provision adds nothing to the draft.
غير أننا نلاحظ أن مشروع المادة ١١ يطبق القاعدة المعاكسة للمادة ٨، إذ تنص على ما يلي: " لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو فريق من اﻷشخاص لا يعمل لحساب هذه الدولة " . فهذا الحكم لا يضيف شيئا إلى المشروع.

For the purposes of the present articles, conduct of any State organ having that status under the internal law of that State shall be considered as an act of the State concerned under international law, provided that organ was acting in that capacity in the case in question.

يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي أيضا تصرف أي كيان لا يشكل جزءا من البنية الرسمية للدولة ولكن يخوله قانون تلك الدولة صلاحية ممارسة بعض اختصاصات السلطة الحكومية شريطة أن يكون الكيان قد تصرف بهذه الصفة في الحالة المعنية.

The conduct of an organ of a State or of an entity empowered to exercise elements of the governmental authority, such organ or entity having acted in that capacity, shall be considered an act of the State under international law even if, in the particular case, the organ or entity exceeded its authority or contravened instructions concerning its exercise.
يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف أي جهاز من أجهزتها أو أي كيان مخول صلاحية ممارسة بعض اختصاصات السلطة الحكومية، يكون قد تصرف بهذه الصفة، حتى ولو كان الجهاز أو الكيان، قد تجاوز، في الحالة المعينة، حدود سلطته أو خالف التعليمات المتعلقة بممارسته.

The paragraph was also contrary to such well-established legal principles of public law as the sovereign immunity of States and the act of the State.

The primary question was whether the act of the State had been intended to produce legal effects vis-à-vis one or more other States which had not participated in its performance and whether it would produce such effects if those States did not accept its consequences, either explicitly, or as implied by their subsequent behaviour.
