28. With regard to the obligation on any State, group or person not to engage in any activity or perform any act aimed at the destruction of rights and freedoms recognized in the Covenant, it should be noted that the Constitution of Azerbaijan contains provisions to the effect that:
٢٨- وجدير بالذكر بصدد التزام كل الدول أو المجموعات أو اﻷشخاص بعدم الاشتراك في أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق والحريات المعترف بها في العهد، بأن الدستور اﻷذربيجاني يضم أحكاماً مؤداها ما يلي:

" Nothing in the present framework Convention shall be interpreted as implying any right to engage in any activity or perform any act contrary to the fundamental principles of international law and in particular of the sovereign equality, territorial integrity and political independence of States.
ليس في أحكام هذه الاتفاقية الإطارية ما يمكن تفسيره على أنه ينطوي على حق أي فرد في مباشرة نشاط أو القيام بعمل يخالف المبادئ الأساسية للقانون الدولي، ولا سيما المساواة في السيادة بين الدول، واحترام سلامتها الإقليمية، واستقلالها السياسي " .

20. Article 15, paragraph 1 (a) may not be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized in the Covenant or at their limitation to a greater extent than is provided for therein.
20- ولا يجوز تـأويل الفقرة 1(أ) من المادة 15 على أنها تنطوي على أي حق لأي دولة أو جماعة أو شخص في مباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق والحريات المعترف بها في العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه().

20. Article 15, paragraph 1 (a) may not be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized in the Covenant or at their limitation to a greater extent than is provided for therein.
20- ولا يجوز تـأوبل الفقرة 1(أ) من المادة 15 على أنها تنطوي على أي حق لأي دولة أو جماعة أو شخص في مباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق والحريات المعترف بها في العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه().

Article 21 of the same instrument reads: " Nothing in the present framework Convention shall be interpreted as implying any right to engage in any activity or perform any act contrary to the fundamental principles of international law and in particular of the sovereign equality, territorial integrity and political independence of States. "
22- تنص المادة 21 من الاتفاقية ذاتها على ما يلي: " ليس في هذه الاتفاقية الإطارية ما يجوز تفسيره بأنه يعني ضمناً أي حق في ممارسة أي نشاط أو القيام بأي عمل يتعارض مع مبادئ القانون الدولي الأساسية وبخاصة المساواة في سيادة الدول وسلامتها الإقليمية واستقلالها السياسي " .

The Committee also based its resolution on article 5, paragraph 1, which prescribes “Nothing in the present Covenant may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized herein or at their limitation to a greater extent than is provided for in the present Covenant”.
وأسندت اللجنة أيضا قرارها إلى الفقرة ١ من المادة ٥، التي تنص على أنه " ليس في هذا العهد أي حكم يجوز تأويله على نحو يفيد انطواءه على حق ﻷي دولة أو جماعة أو شخص بمباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق أو الحريات المعترف بها في هذا العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه " .

The Committee also recalls the provisions of article 5, paragraph 1, of the Covenant according to which " nothing in the present Covenant may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized herein or at their limitation to a greater extent than is provided for in the present Covenant " .
وتشير اللجنة أيضاً إلى أحكام الفقرة 1 من المادة 5 من العهد التي تنص على أنه " ليس في هذا العهد أي حكم يجوز تأويله على أنه يفيد انطواءه على حق لأي دولة أو جماعة أو شخص بمباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق أو الحريات المعترف بها في هذا العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه " .

For example, article 5, paragraph 1, of the International Covenant on Civil and Political Rights provides: " Nothing in the present Covenant may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized herein or at their limitation to a greater extent than is provided for in the present Covenant. "
