فقد جاء في الفقرة ٨ أنه " إذا كان العراق ذاته طرفاً متعاقداً وأخل بالتزاماته التعاقدية، يكون العراق مسؤولاً بموجب قانون العقود العام عن التعويض عن جميع الخسائر الفعلية التي تكبدها الطرف المتعاقد اﻵخر ... " .

The issue raised is whether, in such circumstances, the Difficult Debt Settlement Programme can be regarded as compensating the claimants whose debt was purchased under this programme, i.e., whether the benefits of interest waivers and discounted repayment offered under the Difficult Debt Settlement Programme should otherwise be considered in evaluating the actual losses suffered by claimants who received these benefits post-liberation.
٨٦١- فالقضية المثارة هي ما إذا كان من الممكن، في ظل هذه الظروف، اعتبار برنامج تسوية الديون العسيرة تعويضاً ﻷصحاب المطالبات الذين اشتُريت ديونهم في إطار هذا البرنامج، أي ما إذا كانت المزايا المتمثلة في إسقاط الفائدة ومنح حسومات على المدفوعات في إطار برنامج تسوية الديون العسيرة ينبغي أن تراعى من ناحية أخرى في تقييم الخسائر الفعلية التي تكبدها أصحاب المطالبات الذين تلقوا هذه المزايا بعد التحرير.

44. The additional requirements were primarily attributable to the inadvertent recording of: (a) liability insurance for vehicles; (b) the freight and related costs that was budgeted under the acquisition of various equipment; (c) charges for bottled water that was budgeted under military contingents; and (d) actual losses on exchange rates.
٤٤ - تعزى الاحتياجات الإضافية أساسا إلى القيد بطريق الخطأ لما يلي: (أ) تأمين المسؤولية قبل الغير للمركبات؛ (ب) الشحن والتكاليف ذات الصلة التي أدرجت في الميزانية تحت بند اقتناء معدات مختلفة؛ (ج) تكاليف المياه المعبأة في زجاجات التي أدرجت في الميزانية تحت بند الوحدات العسكرية؛ (د) الخسائر الفعلية في أسعار الصرف.
