3. During a period of deferred compliance pursuant to paragraph 2 of this Article, a High Contracting Party shall only use cluster munitions, other than those described in Technical Annex B, after approval by its highest-ranking operational commander in the area of operations or by the appropriate politically mandated operational authority.

3. 4.
