Promotion of economic, social and cultural rights of Amazighs

The Committee stresses the obligation of the State party, under article 5 of the Convention, to respect the right of Amazighs to enjoy their own culture and to use their own language, in private and public, freely and without discrimination.
تشدد اللجنة على التزام الدولة الطرف، بموجب المادة 5 من الاتفاقية، باحترام حق الأمازيغ في التمتع بثقافتهم واستعمال لغتهم، في حياتهم الخاصة والعامة، بحرية ودون تمييز.

It invites the State party to enhance the enjoyment of the right of association for the protection and promotion of Amazigh culture, and to take measures especially in the field of education in order to encourage knowledge of the history, language and culture of Amazighs.
وهي تدعو الدولة الطرف إلى تدعيم التمتع بحق تكوين جمعيات من أجل حماية وتعزيز الثقافة الأمازيغية واتخاذ تدابير وخاصة في ميدان التعليم من أجل التشجيع على معرفة تاريخ الأمازيغ ولغتهم وثقافتهم.

توصي اللجنة الدولة الطرف بتكثيف جهودها بغية تعزيز اللغة والثقافة الأمازيغيتين، لا سيما عن طريق تعليمهما، كما توصيها باتخاذ التدابير اللازمة لضمان عدم تعرض الأمازيغ لأي شكل من أشكال التمييز العنصري، لا سيما في التوظيف وفي الحصول على الخدمات الصحية.

The Committee notes that, according to some information, there is no recognition of Amazigh language and culture in the Libyan Arab Jamahiriya and Amazighs are impeded from preserving and expressing their cultural and linguistic identity.

72. The World Amazigh Congress (CMA) reported that Tunisia's official position was that Amazighs no longer existed and that the Amazigh language was a local Arabic dialect.
72- أفاد منتدى الأمازيغ العالمي بأن موقف تونس الرسمي يتمثل في أن الأمازيغ ما عادوا موجودين وأن اللغة الأمازيغية تُقدم رسمياً كلهجة محلية مشتقة من العربية(134).

15. The Committee is concerned by reports about economic disparities, affecting in particular the regions inhabited by Amazighs, who allegedly do not benefit from adequate public investment.
15- تشعر اللجنة بالقلق إزاء المعلومات التي تفيد عن التفاوت الاقتصادي الذي يؤثر على وجه التحديد على المناطق التي يسكنها الأمازيغ الذين لا يستفيدون من الاستثمارات العامة الكافية.

The Committee is nevertheless concerned by the persistence of racist stereotypes and by the hate speech that is sometimes directed against the Amazighs, asylum seekers, refugees and sub-Saharan Africans (art. 7).

6. According to the Amazigh World Congress (CMA), the Amazighs account for about one third of the total population, i.e. some ten million people living mainly in the regions of Kabylia, Aurès, Chenoua and M'zab and, in the case of the Tuareg component, in the Sahara.

35. In 2010, CERD was concerned that some Amazighs continue to suffer racial discrimination in accessing employment and health services, as well as in other areas, especially if they do not speak Arabic.
35- في عام 2010، أعربت لجنة القضاء على التمييز العنصري عن قلقها إزاء استمرار معاناة بعض الأمازيغ من التمييز العنصري في التوظيف وفي الحصول على الخدمات الصحية وفي مجالات أخرى، خاصةً إذا كانوا لا يتحدثون اللغة العربية.
