1. The Special Rapporteur welcomes the opportunity to provide the Economic and Social Council with suggestions in connection with the proposed seminar on treaties, agreements and constructive arrangements between States and indigenous peoples.

Indigenous peoples have the right to have the treaties, agreements and constructive arrangements concluded with States, their predecessors and successors be recognized, respected, observed, implemented and enforced in accordance with their original spirit and intent, in good faith, and as understood by indigenous peoples.
للشعوب الأصلية الحق في أن تحظى المعاهدات والاتفاقات والترتيبات البناءة المبرمة مع الدول ومع دولها الخلف ودولها السلف بالاعتراف والاحترام والمراعاة والتنفيذ والإعمال وفقاً لروحها وغرضها الأصليين، بحسن نية، وحسب فهم الشعوب الأصلية لها.

42. The experts requested that the relevant recommendations contained in the United Nations study on treaties, agreements and constructive arrangements and the two United Nations seminars on treaties, agreements and constructive arrangements be taken into consideration by:

The experts reaffirmed the call by the United Nations study on treaties, agreements and constructive arrangements for the international recognition of the treaties concluded between indigenous peoples and States, as well as effective and accessible mechanisms to provide international redress for treaty violations and abrogations.
39- أعاد الخبراء تأكيد ما دعت إليه دراسة الأمم المتحدة الخاصة بالمعاهدات والاتفاقات وغيرها من الترتيبات البناءة بأن يكون هناك اعتراف دولي بالمعاهدات التي تبرم بين الشعوب الأصلية والدول، فضلا عن وجود آليات فعالة يسهل الوصول إليها لجبر الضرر الناجم عن انتهاكات المعاهدات أو وقفها على الصعيد الدولي.

Considering that the rights affirmed in treaties, agreements and constructive arrangements between States and Indigenous Peoples are, in some situations, matters of international concern, interest, responsibility and character.

80. The Permanent Forum recognizes treaty rights, including associated rights to water, as a key element in the comprehensive discussion of indigenous peoples' understanding and interpretation of treaties, agreements and constructive arrangements between indigenous peoples and States.

61. Mr. Jérémie Gilbert (Irish Centre for Human Rights) explained that precedents show that treaty-monitoring bodies could play an important role in the implementation and follow-up to treaties and constructive arrangements signed between indigenous peoples and States.

Mrs. Charmaine White Face stressed that meetings like the treaty seminar, the study on treaties and the information collected by the Commission on Human Rights during the past decade clearly show a need for an advisory body to work only on the topic of treaties and constructive arrangements made between indigenous nations and nation States.

45. The experts reaffirmed the recommendation that the Office of the High Commissioner organize, in conjunction with the Working Group on Indigenous Populations and indigenous treaty nations and organizations, a world conference on indigenous peoples' treaties, agreements and constructive arrangements, to be held during the first half of the Second International Decade of the World's Indigenous People.
45- وأعاد الخبراء تأكيد التوصية الداعية إلى أن تقوم المفوضية، بالتعاون مع الفريق العامل المعني بالشعوب الأصلية، بتنظيم مؤتمر عالمي بشأن المعاهدات والاتفاقات وغيرها من الترتيبات البناءة المتعلقة بالشعوب الأصلية وذلك أثناء النصف الأول من العقد الدولي الثاني للشعوب الأصلية في العالم.

43. The experts called upon the Office of the United Nations High Commissioner for Human Rights to develop, in conjunction with the Working Group on Indigenous Populations and indigenous treaty nations and organizations, a capacity-building and training programme for indigenous peoples, United Nations staff and State representatives in the use of treaties, agreements and constructive arrangements for conflict prevention and resolution.
