In this regard, it should be noted that CRC Article 12 mandates that the views of the child shall be heard `in any judicial and administrative proceedings affecting the child'and be given due weight in accordance with his or her age and maturity.

The Committee on the Rights of the Child adopted its general comment No. 12 on the right of the child to be heard in 2009, in which it addressed, inter alia, the implementation of article 12 (2) of the Convention, which specifies that children must be provided the opportunity to be heard in any judicial and administrative proceedings affecting the child.
