The Working Group reiterates articles 2 and 10 of the Declaration, which provide that " no State shall practise, permit or tolerate enforced disappearances " , and that " accurate information on the detention of any person deprived of liberty and their place or places of detention shall be made promptly available to their family members, their counsel " .

77. any person deprived of freedom of movement by virtue of being held in police custody for the purposes of an investigation is immediately informed of the nature of the offence with which the investigation is dealing and the provisions concerning the duration of custody and related rights, including the right to the assistance of legal counsel.

It urged Cuba to ensure that all detainees enjoy all fundamental legal safeguards; and guarantee the right of any person deprived of their liberty to have access to an immediate remedy to challenge the legality of their detention.
وحثت اللجنةُ كوبا على ضمان تمتع جميع المحتجزين بجميع الضمانات القانونية الأساسية وعلى ضمان حق كل شخص محروم من حريته في الحصول على سبيل انتصاف فوري للطعن في مشروعية احتجازه(66).

Article 2 describes forced disappearance as the deprivation of liberty committed by State or quasi-governmental agents and the subsequent failure to acknowledge that deprivation or concealment of the person, in such a way that the latter does not benefit from the protection that the legal system provides to any person deprived of his or her liberty.
