19. One of the most pertinent of these instruments is the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, adopted by the Economic and Social Council in its resolution 1989/65 of 24 May 1989.
١٩ - وأحد أكثر هذه الصكوك صلة بالموضوع هو مبادئ المنع والتقصي الفعالين لعمليات الاعدام خارج نطاق القانون والاعدام التعسفي والاعدام دون محاكمة، التي اعتمدها المجلس الاقتصادي والاجتماعي في قراره ١٩٨٩/٦٥ المؤرخ ٢٤ أيار/مايو ١٩٨٩.

In this connection, the Special Rapporteur wishes to draw the Government's attention to the standards pertaining to the investigation of extrajudicial executions contained in the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.

In this regard, attention is drawn to paragraph 20 of the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, under which the families and dependants of victims of extra-legal, arbitrary or summary executions shall be entitled to fair and adequate compensation within a reasonable period of time.

(a) The Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions;

It will be recalled that the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions emphasize the absolute respect for life even during " a state of war or threat of war, internal political instability or any other public emergency " .
ويذكر أن مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام بإجراءات موجزة تشدد على الاحترام المطلق للحياة حتى خلال " حالة الحرب أو التهديد بالحرب، أو عدم الاستقرار السياسي الداخلي أو أي حالة طوارئ عامة أخرى " .

2. In the same resolution, the Commission also invited OHCHR and the Crime Prevention and Criminal Justice Division of the Secretariat to consider revising the Manual on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions.

In this context, the Special Rapporteur wishes to refer to the Model Protocol for Disinterment and Analysis of Skeletal Remains, included in the Manual for the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, a United Nations publication.

While the loss of life could be attributed in part to armed conflict, cases of Arbitrary and Summary execution were widespread.(E/CN.4/1992/26), para. 126.

The effective protection of the right to life requires that States, and the United Nations in its engagement in peacekeeping and law enforcement responsibilities, must adequately train law enforcement officials to prevent Arbitrary and Summary executions.
25- وتستوجب الحماية الفعالة للحق في الحياة أن تقوم الدول، والأمم المتحدة أثناء اضطلاعها بعمليات حفظ السلام وبمسؤوليات إنفاذ القوانين، بتوفير التدريب الكافي للموظفين المكلفين بإنفاذ القوانين منعاً لحدوث حالات إعدام تعسفاً وبإجراءات موجزة.

The Committee is also concerned at the lack of conclusive investigations and prosecutions into the killing of Oscar Kamau King'ara and John Paul Oulu who cooperated with the Special Rapporteur on extrajudicial, Arbitrary and Summary executions during his visit to the State party in 2009.
كما يساور اللجنة قلق إزاء عدم مباشرة تحقيقات حاسمة وإجراءات الملاحقة القضائية فيما يتعلق بقتل أوسكار كاماو كينغارا وجون بول أولو اللذين تعاونا مع المقرر الخاص المعني بحالات الإعدام خارج القضاء أو بإجراءات موجزة أو تعسفا خلال زيارته إلى الدولة الطرف في عام 2009.

The duty to prevent extrajudicial, summary or arbitrary executions is clearly set forth in the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.
إن واجب منع وقوع حالات الإعدام خارج نطاق القضاء أو بإجراءات موجزة أو تعسفاً يرد بوضوح في مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعـدام دون محاكمـــة .
