The procuring entity should bear in mind that failures occurring due to reckless or intentional actions by the procuring entity, as well as decisions taken by the procuring entity to address issues arising from failures of its automatic systems, including on an extension of the applicable deadline, could give rise to a right of challenge by aggrieved suppliers and contractors under chapter VIII of the Model Law.
وعلى الجهة المشترية أن تأخذ في الاعتبار أنَّ الأعطال التي تقع بسبب تصرفاتها المستهترة أو المتعمّدة وكذلك بسبب القرارات التي تتخذها لمعالجة المسائل الناشئة عن الأعطال في نظمها الآلية، بما في ذلك تمديد الموعد النهائي المنطبق، يمكن أن تفضي إلى منح المورِّدين أو المقاولين المتضررين حق الطعن بموجب الفصل الثامن من القانون النموذجي.

The reasons for their disqualification will be communicated to them in accordance with articles 17 (10) and 48 (3)(e) and this should give them sufficient information to consider whether to challenge under chapter VIII of the Model Law their exclusion.
وتقضي الفقرة (10) من المادة 17 والفقرة الفرعية (3) (هـ) من المادة 48 بإبلاغ هؤلاء المورِّدين أو المقاولين بأسباب عدم تأهيلهم؛ وينبغي أن تعطيهم تلك الأسباب ما يكفي من معلومات للنظر في تقديمهم اعتراضاً على استبعادهم بموجب الفصل الثامن من القانون النموذجي.

The purpose of the provision in paragraph (3) allowing disclosure to the suppliers or contractors of the relevant parts of the record at the time when the decision to accept a particular submission (or the decision to cancel the procurement proceedings) has become known to them is to give efficacy to the right to challenge under article 63 (which falls within chapter VIII of the Model Law).
7- والغرض من الحكم الوارد في الفقرة (3) بالسماح بإطلاع المورِّدين أو المقاولين على أجزاء السجل ذات الصلة عندما يتناهى إلى علمهم قرارُ قبول عرض بعينه (أو قرارُ إلغاء إجراءات الاشتراء) هو تفعيل حق الاعتراض الذي تكفله المادة 63 (التي تقع ضمن الفصل الثامن من القانون النموذجي).

In a few States, the legislation stipulates that the provisions modelled on chapter VIII of the Model Law on recognition and enforcement of awards (arts. 35 and 36) apply also to orders made under the provision modelled on article 17 of the Model Law.
