The Committee agreed that recommendation 204 provided the appropriate law and recalled the decision taken by the Commission at its thirty-ninth session to approve the substance of the recommendations of the draft Guide, including recommendation 204. It was also agreed that the commentary to the chapter should fully discuss the policy reasons justifying the approach taken in recommendation 204.

Recalling that it had approved the substance of the commentary to the chapter on transition during the first part of its fortieth session (A/62/17 (Part I), para. 158), the Commission approved the substance of the revised commentary and requested the Secretariat to make any consequential changes to reflect the decisions taken by the Commission with respect to the commentary in the context of its discussion of the recommendations.
