Criteria Although the decision to approve the transfer of arms is a sovereign decision of each Member State, Mexico will seek to ensure that the treaty establishes high standards to prevent trade in arms when there is a substantial risk that they will be used to commit or facilitate grave violations of international humanitarian law or grave and systematic violations of international human rights law.

It also includes robust and effective regulation of the arms trade, in addition to appropriate control over the circulation of existing and often illicit conventional arms, including small arms, to prevent their use to commit or facilitate serious acts of gender-based violence.

34. The Committee recommends that the State party ensure, including through the adoption of relevant legislation, the seizure and confiscation of materials, assets and other goods used to commit or facilitate any of the offences under the Optional Protocol, the seizure and confiscation of proceeds derived from them, and the closure of premises used to commit such offences, in accordance with article 7 of the Optional Protocol.
34- توصي اللجنة الدولة الطرف بأن تضمن، بوسائل مختلفة منها اعتماد تشريع ذي صلة، الحجز على المواد والموجودات وغيرها من السلع التي تُستخدم في ارتكاب أو تسهيل أي جريمة من الجرائم المشمولة بالبروتوكول الاختياري ومصادرتها، وكذلك الحجز العوائد المتأتية من ارتكاب هذه الجرائم ومصادرتها وإغلاق المباني المستخدمة على لارتكاب هذه الجرائم وفقاً للمادة 7 من البروتوكول الاختياري.

33. The Committee recommends that the State party ensure, including through the adoption of relevant legislation, the seizure and confiscation of materials, assets and other goods used to commit or facilitate any of the offences under the Optional Protocol, the seizure and confiscation of proceeds derived from them, and the closure of premises used to commit such offences, in accordance with article 7 of the Optional Protocol.
33- توصي اللجنة الدولة الطرف بأن تضمن، بوسائل مختلفة منها اعتماد تشريع ذي صلة، حجز المواد والموجودات وغيرها من السلع التي تُستخدم في ارتكاب أو تسهيل أي جريمة من الجرائم المنصوص عليها في البروتوكول الاختياري ومصادرتها، وكذلك حجز العوائد المتأتية من ارتكاب هذه الجرائم ومصادرتها وإغلاق المباني المستخدمة لارتكاب هذه الجرائم وفقاً للمادة 7 من البروتوكول الاختياري.
