Depending on the facts and circumstances of the particular case, a failure to disclose may eliminate the right of a Contracting State to invoke paragraph 3 (a) to avoid its obligations under paragraph 1. 16.4.

٢ - بالنسبة لكل دولة تصبح دولة متعاقدة في هذه الاتفاقية بعد تاريخ ايداع الصك الخامس الخاص بالتصديق أو القبول أو الاقرار أو الانضمام، يبدأ نفاذ هذه الاتفاقية في اليوم اﻷول من الشهر التالي لانقضاء سنة على تاريخ ايداع الصك اللازم من قبل تلك الدولة.

It was further suggested that the second option might be combined with a provision that allowed a Contracting State to generally exclude the possibility of an extended application of the provisions of the draft convention to matters covered in international conventions other than those listed in draft article Y, paragraph 1.
