Even during a state of emergency, nobody should be held guilty of a criminal offence on account of any act or omission which did not constitute a criminal offence at the time it was committed.

Article 15 of the Covenant states that, a person shall not be held guilty of a criminal offence on account of any act or omission which was not an offence at the time that it was committed, but this should not prejudice the trial and punishment of a person for an act or omission committed which was criminal according to international law.
١٩- تنص المادة ١٥ من العهد على ألا يُدان أي فرد بأي جريمة بسبب فعل أو امتناع عن فعل لم يكن وقت ارتكابه يشكل جريمة، على ألا يخل ذلك بمحاكمة ومعاقبة أي شخص على أي فعل أو امتناع عن فعل كان يشكل جرما وفقا للقانون الدولي.

Article 40 (2) (a) of CRC affirms that the rule that no one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence, under national or international law, at the time it was committed is also applicable to children (see also article 15 of ICCPR).
