The supplementary report (S/2002/601) states that custodianship is a matter of judicial decision and freezing of assets is left to the discretion of the competent authorities as provided by the socialist public prosecutor law and the bank secrecy law.

The Egyptian legislator thus introduced the system of the socialist public prosecutor, upon whom he conferred the task of instigating proceedings to take custodianship of such assets in accordance with the conditions stipulated in the Act.
فقد استحدث المشرع المصري نظام المدعي العام الاشتراكي وخصه بتحريك دعوى الحراسة على تلك الأموال وفقا للشروط الواردة بالقانون.

Article 4 also states that custodianship may be imposed, in accordance with the provisions of the Act, over the assets of bodies corporate if one of the reasons stipulated in the above two articles obtains in their regard.
