During his term of office, the group had worked on preparing a draft convention on electronic contracting and the elimination of legal obstacles to the development of electronic commerce and instruments relating thereto, a convention that would be very useful in promoting electronic commerce, by contributing security and standardization with the formulation of clear provisions on Electronic Contracts.

It was suggested that the UNCITRAL Arbitration Rules, when read in conjunction with other instruments, such as the UNCITRAL Model Law on Electronic Commerce and the Convention on Electronic Contracts, already accommodated a number of issues arising in the online context.
وقيل إن قواعد الأونسيترال للتحكيم، عندما تُقرأ مقرونة بصكوك أخرى، مثل قانون الأونسيترال النموذجي بشأن التجارة الإلكترونية واتفاقية العقود الإلكترونية تستوعب بالفعل عددا من المسائل التي تنشأ في سياق الاتصال الحاسوبي المباشر.

265. The Commission heard a report on the special event that took place on 6 July 2006 at United Nations Headquarters, in New York, which included the ceremony of the signing of the Convention on Electronic Contracts.

231. The Commission noted the finalization by the Secretariat of the explanatory note relating to the Convention on Electronic Contracts (A/CN.9/608 and Add.1-4).
231- ولاحظت اللجنة أن الأمانة قد وضعت المذكرة التفسيرية المتعلقة باتفاقية العقود الإلكترونية في صيغتها النهائية (A/CN.9/608 وAdd.1 إلى Add.4).

Compliance of paragraph (2) of the revised draft article 7 with the UN Convention on the Use of Electronic Communications in International Contracts ( " the Convention on Electronic Contracts " )
امتثال الفقرة (2) من مشروع المادة 7 المنقّح من اتفاقية الأمم المتحدة بشأن استخدام الخطابات الإلكترونية في العقود الدولية ( " اتفاقية العقود الإلكترونية " )

:: The language used in paragraph (4) of the proposal was consistent with that used in paragraph (2) of article 9 of the Convention on Electronic Contracts.
● الصيغة المستخدمة في الفقرة (4) من الاقتراح تتسق مع الصيغة المستخدمة في الفقرة (2) من المادة 9 من اتفاقية العقود الإلكترونية.

After discussion, the Working Group agreed to retain the words " electronic communication " and to include under paragraph (4) of the above proposal the definition of " electronic communication " and " data message " as contained in paragraphs (b) and (c) of article 4 of the Convention on Electronic Contracts.
وبعد المناقشة، اتفق الفريق العامل على الاحتفاظ بعبارة " الخطاب الإلكتروني " وعلى أن يُدرج في الفقرة (4) من الاقتراح الوارد أعلاه تعريف " للخطاب الإلكتروني " و " لرسالة البيانات " على النحو الوارد في الفقرتين (ب) و(ج) من المادة 4 من اتفاقية العقود الإلكترونية.

On the other hand, paragraph 10 of the Note states that: " The Commission noted, in particular, the proposal that the Working Group's considerations should not be limited to Electronic Contracts, but should apply to commercial contracts in general, irrespective of the means used in their negotiation. "
ومن ناحية أخرى، جاء في الفقرة 10 من المذكّرة أن " اللجنة نوّهت خصوصا بالاقتراح الداعي إلى ألاّ يقتصر نظر الفريق العامل على العقود الإلكترونية بل أن يشمل العقود التجارية بصفة عامة، بغض النظر عن الوسيلة المستخدمة في التفاوض بشأنها " .

Moreover, the Working Group had then been invited to consider dealing not only with Electronic Contracts or contract-related communications, but also with other transactions conducted electronically, subject to specific exclusions that the Working Group might deem appropriate (A/CN.9/527, para. 77).

In that connection, the Commission noted that article 10 of the United Nations Convention on the Use of Electronic Communications in International Contracts (the " Convention on Electronic Contracts " ) provided guidance with respect to the time and place of dispatch and receipt of electronic communications.

157. In favour of its deletion, it was said that it was inappropriate for legislation relating to arbitration to contain provisions on electronic communications and that the definitions provided under paragraph 4 were already contained in other UNCITRAL instruments, namely the UNCITRAL Model Law on Electronic Commerce and the Convention on Electronic Contracts.
157- وقيل، تأييدا لحذف الفقرة (4)، إنّه لا يصحّ لتشريع متعلق بالتحكيم أن يتضمن أحكاما بشأن الاتصالات الإلكترونية وإنّ التعاريف التي تتضمنها هذه الفقرة واردة أصلا في صكوك أخرى من صكوك الأونسيترال، وتحديدا في قانون الأونسيترال النموذجي بشأن التجارة الإلكترونية() واتفاقية العقود الإلكترونية.

An alternative proposal was made to retain paragraph 4, but simplify its content by referring in footnotes to the definitions that were already contained in the UNCITRAL Model Law on Electronic Commerce and the Convention on Electronic Contracts.
وقُدِّم اقتراح بديل يدعو إلى الاحتفاظ بالفقرة (4) ولكن مع تبسيط محتواها بالإشارة في الحواشي إلى التعاريف الواردة أصلا في قانون الأونسيترال النموذجي بشأن التجارة الإلكترونية واتفاقية العقود الإلكترونية.

15. The language used in paragraph (4) was consistent with that used in paragraph (2) of article 9 of the United Nations Convention on the Use of Electronic Communications in International Contracts ( " the Convention on Electronic Contracts " ) and the definitions of " electronic communication " and " data message " reproduced the definitions contained under subparagraphs (b) and (c) of article 4 of the Convention on Electronic Contracts.
15- رُئي أن الصيغة المستخدمة في الفقرة (4) متسقة مع تلك المستخدمة في الفقرة (2) من المادة 9 من اتفاقية الأمم المتحدة بشأن استخدام الخطابات الإلكترونية في العقود الدولية ( " اتفاقية العقود الإلكترونية " )، وأن تعريفي " الخطاب الإلكتروني " و " رسالة البيانات " مستنسخان من التعريفين الواردين في الفقرتين الفرعيتين (ب) و(ج) من المادة 4 من اتفاقية العقود الإلكترونية.()
