Article 4: We agree that the assignment of receivables through the endorsement of a negotiable instrument (i.e. a bill of exchange, promissory note or (cheque)) should be excluded, since the act of assignment is legally distinct from the act of endorsement and has different consequences.
المادة 4: نوافق على أن احالة مستحقات عن طريق تظهير صك قابل للتداول (ككمبيالة أو سند إذني أو شيك) ينبغي أن تستبعد، نظرا لأن اجراء الاحالة متميز قانونا عن اجراء التظهير وله آثار مغايرة.

What justifies the exclusion is not the nature of the instrument representing the receivable (bill of exchange, promissory note, (cheque), etc.), but the technique of transfer, namely endorsement or delivery.
وما يبرر الاستبعاد ليس هو طبيعة الصك الذي يمثل المستحق (الكمبيالة أو السند الاذني أو الشيك، الخ.)، وإنما هو تقنية النقل، أي التظهير أو التسليم.
