Non-participation of a member in the examination of a communication

1. A member shall not take part in the examination of a communication by the Committee if:

Reservations have been entered which effectively add an additional ground of inadmissibility under article 5, paragraph 2, by precluding examination of a communication when the same matter has already been examined by another comparable procedure.
وقد أدرجت تحفظات تؤدي من الناحية الفعلية الى اضافة مبرر آخر لعدم جواز قيام اللجنة، بمقتضى الفقرة ٢ من المادة ٥، بالنظر في بلاغ ما حينما يكون نفس الموضوع قد سبق أن بحث في اطار اجراء مماثل آخر.

44. While many delegations favoured the use of written information only in the examination of a communication, some suggested that that issue should be left to the Committee to determine.
