The Federal Act on the Prevention and Elimination of Discrimination provides for affirmative action and compensatory measures to be taken by public bodies and federal authorities to promote equal opportunities for historically vulnerable groups.

336. In the report submitted to the United Nations Division for the Advancement of Women (DAW) in April 2004, Mexico mentioned approval of the Federal Act on the Prevention and Elimination of Discrimination and the creation of the National Council for the Prevention of Discrimination.

339. The work done by the Commission gave rise to a bill which subsequently became the Federal Act on the Prevention and Elimination of Discrimination, published on 11 June 2003, as the first specific law regulating Article 1 of the Constitution.

36. On 24 April 2012, the Senate adopted an amendment to the Federal Act on the Prevention and Elimination of Discrimination, modifying the definition of discrimination to include racial segregation, racial discrimination and related forms of intolerance.

73. The Federal Act on the Prevention and Elimination of Discrimination (LFPED) establishes a complaints mechanism that enables CONAPRED to investigate all discriminatory acts against persons with disabilities.

Although the State party has carried out important legislative reforms, the Committee notes with concern that the definition of discrimination in the Federal Act on the Prevention and Elimination of Discrimination contains no mention of racial discrimination and is not in line with the Convention.

The Committee is concerned at the low number of complaints and rulings regarding cases of discrimination on grounds of disability, the lack of regulations under the Federal Act on the Prevention and Elimination of Discrimination and the dearth of information on its dissemination in accessible formats, including in different indigenous languages.

12. The Committee recommends that the State party allocate resources to have the Federal Act on the Prevention and Elimination of Discrimination translated into all indigenous languages in accessible formats (including Braille, sign language, easy-read and electronic formats).

9. On 20 March 2014, the reform of the Federal Act on the Prevention and Elimination of Discrimination was promulgated, strengthening the guarantees concerning the right to equality and non-discrimination recognized in article 1 of the Constitution and providing for the prohibition of discrimination based, among other things, on disability.

The implementing regulations for these provisions are set out in the Federal Act on the Prevention and Punishment of Torture, which is now being reviewed and amended by Congress in accordance with the recommendations made by the Committee against Torture of the United Nations.

54. On 11 April 2012 the Senate approved amendments to the Federal Act on the Prevention, Punishment and Eradication of Torture in order to prohibit cruel, inhuman or degrading treatment of persons arrested, detained or imprisoned.

231. With regard to investigations conducted by the Office of the Attorney-General of the Republic, 17 preliminary investigations were initiated during the period between 1 March 2011 and 30 April 2012 concerning offences provided for under the Federal Act on the Prevention and Punishment of Torture, the outcome being one indictment.
