The term " high seas " is used to refer to all parts of the sea that are not included in the internal waters, territorial sea, archipelagic waters or exclusive economic zone of States,2 whereas the Area comprises the seabed and ocean floor and subsoil thereof beyond the limits of national jurisdiction, designated under UNCLOS as the common heritage of mankind.3
