In this regard, a matter of particular concern is the footnote to article 1.2 of the WTO Agreement on Rules of Origin which explicitly excludes from its scope of application the definition of domestic industry in anti-dumping proceedings as this may allow the investigating authorities to continue to use arbitrary standards for determining whether a domestic producer is really " domestic " .

Such indications, which may be particularly useful for those countries where there does not exist a discrete body of commercial law, are modelled, for reasons of consistency, on the footnote to article 1 of the UNCITRAL Model Law on International Commercial Arbitration (also reproduced as footnote **** to article 1 of the UNCITRAL Model Law on Electronic Commerce).

It was agreed that, in line with the footnote to article 35, the conditions set forth in that article were intended to set maximum standards and that the explanatory material should clarify that deletion of the certification requirement should not be read as ruling out the possibility that certification might be required by judges, where appropriate and in accordance with local law.
