2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may consider this Protocol as a legal basis for extradition in respect of such offences.
2 - إذا تلقت دولة طرف تجعل تسليم المجرمين مشروطاً بوجود معاهدة طلباً لتسليم مـجرم من دولـة طـرف أخـرى لا تربطها بها معاهدة لتسليم المجرمين يجوز لها أن تعتبر هذا البروتوكول قانونياً لتسليم المجرم فيما يتعلق بتلك الجرائم.

2. If a Contracting State which makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, it shall consider the present Convention as the legal basis for extradition in respect of the offences mentioned in article 1 of this Convention.
٢ - إذا تلقت دولة من الدول المتعاقدة التي تشترط وجود معاهدة لتسليم المجرمين طلب تسليم من دولة أخرى من الدول المتعاقدة لا تربطها بها معاهدة لتسليم المجرمين، فعليها أن تعتبر هذه الاتفاقية اﻷساس القانوني للتسليم فيما يتصل بالجرائم المذكورة في المادة ١ من هذه الاتفاقية.

Pursuant to paragraph 2, if a Contracting State which makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, it may at its option consider the Convention as the legal basis for extradition in respect of the offence, subject to the other conditions provided by its law.
وعملا بالفقرة 2، إذا كانت دولة متعاقدة تجعل التسليم مشروطا بوجود معاهدة تسليم وتلقت طلب تسليم من دولة متعاقدة أخرى لا تربطها بها معاهدة تسليم، فبإمكانها إن شاءت أن تعتبر الاتفاقية بمثابة الأساس القانوني للتسليم فيما يخص الجريمة، مع مراعاة الشروط الأخرى المنصوص عليها في قوانينها.

5- إذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يخص أي جرم تنطبق عليه هذه المادة.

" ٢ - إذا تلقت دولة طرف تعلﱢق تسليم المجرمين على شرط وجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، فلها أن تختار اعتبار هذه الاتفاقية اﻷساس القانوني للتسليم بخصوص تلك الجرائم.

6. States Parties which, pursuant to paragraph 2 of this article, have agreed to consider this Convention as a legal basis for extradition in respect of the offences set forth in article 2 may consider utilizing the procedures set out in Annex III.
6 - يمكن للدول الأطراف، التي وافقت، عملا بالفقرة 2 من هذه المادة، على اعتبار هذه الاتفاقية أساسا قانونيا لتسليم المجرمين في الجرائم المنصوص عليها في المادة 2، أن تنظر في استخدام الإجراءات الواردة في المرفق الثالث.

Likewise, it recommends that the State party use the possibility provided under article 5.2 to invoke the Protocol as the juridical basis for extradition in respect of crimes included therein, even if no bilateral agreement exists.
كما توصي اللجنة الدولة الطرف باستخدام الإمكانية التي تتيحها الفقرة 2 من المادة 5 للاحتجاج بالبروتوكول كأساس قانوني لتسليم المطلوبين في الجرائم التي يشملها البروتوكول، حتى في حال عدم وجود اتفاقات ثنائية.
