Having taken into account the developments in the process designed to determine Kosovo's future status, I fully support both the recommendation made by my Special Envoy in his report on Kosovo's future status and the Comprehensive Proposal for the Kosovo Status Settlement.

1. The aim of the Comprehensive Proposal for the Kosovo Status Settlement is to define the provisions necessary for a future Kosovo that is viable, sustainable and stable.

2. On 2 February, my Special Envoy for the Future Status Process for Kosovo, Martti Ahtisaari, submitted a draft comprehensive proposal for the Kosovo Status settlement to the political leaderships in Belgrade and Prishtinë/Priština.

After 15 months of United Nations-sponsored negotiations, President Ahtisaari prepared a Comprehensive Proposal for the Kosovo Status Settlement, which included measures to protect Kosovo's non-Albanian communities, and a recommendation that Kosovo should become independent subject to a period of international supervision.

235. In its declaration of independence of 17 February 2008, Kosovo's Assembly expressly accepts the recommendations of the U.N. Special Envoy's Comprehensive Proposal for the Kosovo Status Settlement, and adds that

5. The parties in the Unity Team remain committed to the Comprehensive Proposal for the Kosovo Status Settlement (see S/2007/168/Add.1) and have called for the accelerated adoption of legislation in accordance with annex XII to the settlement proposal.

On 3 April, the Special Envoy of the Secretary-General briefed the Council during a private debate on his Comprehensive Proposal for the Kosovo Status Settlement (S/2007/168/Add.1 and 2).

The Court further notes that the Comprehensive Proposal for the Kosovo Status Settlement provided for the appointment of an International Civilian Representative (ICR), who would have the final authority in Kosovo regarding interpretation of the Settlement (ibid., Art. 12).

3. On 3 April 2007, I submitted to the Security Council the Comprehensive Proposal for the Kosovo Status Settlement (S/2007/168/Add.1), prepared by my Special Envoy for the Future Status Process for Kosovo, Martti Ahtisaari.

70. The Special Envoy's conclusions were accompanied by his finalized Comprehensive Proposal for the Kosovo Status Settlement (S/2007/168/Add. 1, 26 March 2007), which, in his words, set forth " international supervisory structures, provide[d] the foundations for a future independent Kosovo " (S/2007/168, 26 March 2007, para. 5).

The Secretary-General " fully support[ed] both the recommendation made by [his] Special Envoy in his report on Kosovo's future status and the Comprehensive Proposal for the Kosovo Status Settlement " (Letter dated 26 March 2007 from the Secretary-General addressed to the President of the Security Council, S/2007/168).

They have committed themselves to implementing in full the Comprehensive Proposal for the Kosovo Status Settlement prepared by my then Special Envoy for the Kosovo Future Status Process, Martti Ahtisaari, and conveyed to the Security Council on 26 March 2007 (S/2007/168/Add.1).

5. The Kosovo Serb political leadership in northern Kosovo continued to express opposition to the deployment to the north of the International Civilian Office, foreseen in the Comprehensive Proposal for the Kosovo Status Settlement (S/2007/168/Add.1), which was not endorsed by the Security Council.

Furthermore, the Secretary-General's report of 24 November 2008 on UNMIK (S/2008/692), which also underlined that the Comprehensive Proposal for the Kosovo Status Settlement (S/2007/168/Add.1) had not been endorsed by the Security Council, referred only to an enhanced operational role for EULEX in the rule of law area.
