39. Concerning the establishment of a survivors' lump sum benefit in the event of the death of serving members of ICJ, the General Assembly, in its resolution 40/257 C, approved the recommendation of the Advisory Committee to establish, in addition to the existing pension scheme, a death-benefit scheme for the members of ICJ.

35. Based on the analysis and findings of a consulting actuary's report, the Secretary-General believed that the pension scheme for the members of ICJ should provide adequate after-service benefits to judges having met the requisite eligibility criteria relating to retirement age and period of service based on the premise that the pension benefit maintains a standard of living as replacement income.
35 - واستنادا إلى التحليل والاستنتاجات الواردين في تقرير الخبير الاكتواري الاستشاري، يعتقد الأمين العام أن خطة المعاشات التقاعدية لأعضاء محكمة العدل الدولية ينبغي أن توفر استحقاقات كافية لما بعد انتهاء الخدمة للقضاة الذين تتوافر فيهم معايير الأهلية المطلوبة المتعلقة بسن التقاعد وفترة الخدمة استنادا إلى فرضية أن استحقاق المعاش التقاعدي يحافظ على مستوى من المعيشة كدخل بديل.

94. Based on the decision of the General Assembly contained in section VIII of its resolution 53/214 to set the retirement pension for the members of ICJ at half the annual salary, the annual retirement benefit of a member of the Court retiring in 2005 would increase from $80,000 per annum to $88,500 with effect from 1 January 2005.

In paragraph 29 of its report (A/53/7/Add.6), the Advisory Committee recommended the pension benefit for the judges of the two Tribunals be based on that applicable to the members of ICJ, prorated to account for the difference in length in the terms of appointment, that is to say, nine years for the members of ICJ versus four years for the judges of both Tribunals.
