Article 3, paragraph 1, of the Fourteenth Constitutional Decree stipulates as follows:

56. Recently promulgated, the Fourteenth Constitutional Decree giving effect to the Peace Agreement of 1997 sets forth guiding principles in chapter II, article 3, paragraph 3 of which provides that legislation which prejudices the fundamental rights and freedoms of citizens may not be enacted.
56- وصدر مؤخراً المرسوم الدستوري الرابع عشر تنفيذاً لاتفاقية السلام لسنة 1997 ونص في الفصل الثاني منه على المبادئ التوجيهية فنص البند 3 من المادة 3 على أنه لا يجوز سن أي تشريع يضر بالحريات والحقوق الأساسية للمواطنين.

266. In connection with the Convention of the Rights of the Child, one of the most recent legislative enactments relevant to the education system is the Fourteenth Constitutional Decree embodying the Khartoum Peace Agreement, concluded on 21 April 1997, which covers freedoms, full participation in decision-making and the subject of languages.
266- إن من أحدث التشريعات ذات الصلة بالنظام التعليمي فيما يختص باتفاقية حقوق الطفل هو المرسوم الدستوري الرابع عشر المتضمن لاتفاقية الخرطوم للسلام الموقعة في 21 نيسان/أبريل 1997 والذي يتناول الحريات والمشاركة الكاملة في اتخاذ القرار وموضوع اللغات.

It should be noted that the draft permanent constitution of 1998 includes a provision pursuant to which the Khartoum Peace Agreement and the Fourteenth Constitutional Decree of 1997 are to be regarded as integral to the constitution subsequent to its approval by the popular referendum scheduled to take place next June.
وجدير بالذكر أن مشروع الدستور الدائم للبلاد للعام 1998 قد تضمن نصا لاعتبار اتفاقية الخرطوم والمرسوم الدستوري الرابع عشر لسنة 1997 جزءا لا يتجزأ من الدستور عقب إجازته بالاستفتاء الشعبي في حزيران/يونيه المقبل بمشيئة الله.

338. In accordance with the Khartoum Peace Agreement, the Fourteenth Constitutional Decree and the Peace and Transitional Measures for the Southern States Act, utmost priority is accorded to dealing with pressing matters such as displaced child soldiers, unaccompanied children and mine clearance.

58. Article 3, paragraph 9, of the Fourteenth Constitutional Decree of 1997 stipulates that the State must endeavour to ensure development at the state level and eliminate the disparities in basic services among the different states by drawing up a comprehensive social and economic plan. It also stipulates that priority should be given to the least developed states.
58- نصت المادة 3(9) من المرسوم الدستوري الرابع عشر لسنة 1997 على أن تعمل الدولة لتنمية الولايات وإزالة الفوارق بينها في الخدمات الأساسية وذلك بوضع خطة اقتصادية واجتماعية شاملة كما نصت على إعطاء أولوية للولايات الأقل نمواً.

94. Article 3, paragraph 3, of the Fourteenth Constitutional Decree of 1997 stipulates that: " Legislation which prejudices the fundamental freedoms and rights of citizens may not be enacted. " This provision therefore guarantees the protection of fundamental freedoms and rights, including freedom of expression for all adults and children.
94- نصت المادة 3(3) من المرسوم الدستوري الرابع عشر لسنة 1997 على أنه " لا يجوز سن أي تشريع يضر بالحريات والحقوق الأساسية للمواطنين " ، وبالتالي يكون هذا النص ضمانة لحماية الحريات والحقوق الأساسية بما في ذلك حرية التعبير للجميع كباراً وأطفالاً.

In some instances, the Sudan enacted new laws guaranteeing to safeguard those rights, such as the Asylum Act of 1974, the Convention on the Rights of the Child of 1989, which is now a Sudanese legislative enactment, the Seventh Constitutional Decree of 1993, the Fourteenth Constitutional Decree of 1997, the Khartoum Peace Agreement and the Peace and Transitional Measures for the Southern States Act of 1997.
وفي بعض الحالات سن السودان قوانين جديدة ضمانا لصيانة تلك الحقوق مثل قانون تنظيم اللجوء لسنة 1974 واتفاقية حقوق الطفل لسنة 1989 التي أصبحت جزءا من التشريعات السودانية وكذلك المرسوم الدستوري السابع لسنة 1993 والمرسوم الدستوري الرابع عشر لسنة 1997 باتفاقية الخرطوم للسلام، وقانون السلام والتدابير الانتقالية للولايات الجنوبية لسنة 1997.

104. With the promulgation of the Constitution of Sudan of 1998, all constitutional decrees were cancelled as of the date of the entry into force of the aforementioned Constitution, except for the Fourteenth Constitutional Decree (Implementation of the Peace Agreement) of 1997, which was considered an integral part of the Constitution, having the same sanctity as constitutional provisions.
104- بصدور دستور السودان لسنة 1998، ألغيت من تاريخ نفاذه جميع المراسيم الدستورية ما عدا المرسوم الدستوري الرابع عشر (تنفيذ اتفاق السلام) لسنة 1997 الذي اعتبر جزءاً لا يتجزأ من الدستور، وبذلك أصبح الاتفاق جزءاً لا يتجزأ من الدستور يتمتع بحرمة النصوص الدستورية.

105. The KPA guaranteed the right of the Southern states to legislate, through the codification of their customs and culture and the safeguarding of their particularities (article 3 (4) of the Fourteenth Constitutional Decree (CD)), in addition to the participation of the citizens of Southern Sudan in constitutional and federal institutions (article 3 (8) of the Fourteenth CD).
105- كفل اتفاق الخرطوم للسلام حق الولايات الجنوبية في التشريع وذلك بتقنين أعرافها وثقافتها والمحافظة على خصوصيتها (المادة 3(4) من المرسوم الدستوري الرابع عشر)، إضافة إلى مشاركة مواطني الجنوب في المؤسسات الدستورية والاتحادية (المادة 3(8) من المرسوم ذاته).

282. Prior to the Interim Constitution of 2005, this right was confirmed in the Fourteenth Constitutional Decree (Implementation of the Peace Agreement 1997), which prohibits in article 3 of Chapter 2 the promulgation of any legislation which violates fundamental rights including the freedom of belief.
282- وقبل صدور الدستور الانتقالي لسنة 2005 تأكد هذا الحق في المرسوم الدستوري الرابع عشر (تنفيذ اتفاق السلام 1997)، الذي حظر في المادة الثالثة من الفصل الثاني منه إصدار أي تشريع ينتهك الحقوق الأساسية بما في ذلك حرية العقيدة.

Paragraph 3 (f) also provides that citizenship is the basis of public rights and duties. By virtue of their citizenship, all Sudanese participate on an equal footing in political, economic, social and cultural life. The Fourteenth Constitutional Decree of 1997 therefore enshrines the principle of public freedoms and duties and the fundamental rights of citizens, which all Sudanese share by virtue of their citizenship.
كما نصت الفقرة (و) على أن المواطنة هي أساس الحقوق والواجبات العامة، ويشارك جميع السودانيين بحكم مواطنتهم على قدم المساواة في الحياة السياسية والاقتصادية والاجتماعية والثقافية؛ وعليه فإن المرسوم الدستوري الرابع عشر لسنة 1997 قد ضمن مبدأ الحريات والواجبات العامة والحقوق الأساسية للمواطنين، ويشارك فيها جميع السودانيين بحكم مواطنتهم.
