It was therefore proposed that such a definition could read as follows: "'services' means any object of procurement other than goods or construction. "

30. It was observed that the intention of the Working Group should be to provide a simple definition to the effect that any procurement that did not involve the procurement of goods or construction would be a procurement of services.
٠٣ - ولوحظ أنه ينبغي أن يكون في نية الفريق العامل اعطاء تعريف بسيط يكون من آثاره اعتبار أي اشتراء لا يتناول اشتراء السلع أو الانشاءات اشتراء للخدمات.

)ﻫ( يقصد بمصطلح " الخدمات " أي شيء للاشتراء غير السلع أو الانشاءات )ويجوز للدولة المشرعة أن تحدد أشياء معينة تقرر معاملتها كخدمات(؛

(1) Except as otherwise provided by this chapter, a procuring entity engaging in procurement of goods or construction shall do so by means of tendering proceedings.
)١( باستثناء ما ينص عليه هذا الفصل خلافا لذلك، على الجهة المشترية التي تزاول اشتراء السلع أو الانشاءات أن تقوم بذلك العمل عن طريق اجراءات المناقصة.

105. It was noted that, in paragraph (h), the words " goods or construction " would be replaced by the words " goods, construction or services " .

(ج) السعر المقدّم من المورّد أو المقاول لتنفيذ اقتراحه، وتكاليف تشغيل السلع أو الإنشاءات المقترحة وصيانتها وإصلاحها.

(b) The cost of operating, maintaining and repairing goods or of construction; the time for delivery of goods, completion of construction or provision of services; the characteristics of the subject matter of the procurement, such as the functional characteristics of goods or construction and the environmental characteristics of the subject matter; and the terms of payment and of guarantees in respect of the subject matter of the procurement;
(ب) تكاليفَ تشغيل السلع أو الإنشاءات وصيانتها وإصلاحها، ووقت تسليم السلع أو إنجاز الإنشاءات أو تقديم الخدمات، وخصائص الشيء موضوع الاشتراء، مثل الخصائص الوظيفية للسلع أو الإنشاءات والخصائص البيئية للشيء موضوع الاشتراء، والشروط الخاصة بسداد ثمن الشيء موضوع الاشتراء، وبالكفالات المتعلقة به؛

As to the mechanics of applying the margin of preference, this may be done, for example, by deducting from the submission prices of all submissions import duties and taxes levied in connection with the supply of the goods or construction, and adding to the resulting submission prices, other than those that are to benefit from the margin of preference, the amount of the margin of preference or the actual import duty, whichever is less.
أما فيما يخصّ آليات تطبيق هامش التفضيل، فإنَّ ذلك يمكن عمله، على سبيل المثال، بأن تُخصم من الأسعار الواردة في جميع العروض المقدَّمة رسوم وضرائب الاستيراد المفروضة فيما يخصّ توريد السلع أو الإنشاءات ويضاف إلى أسعار العروض الناتجة، عدا تلك التي ستستفيد من هامش التفضيل، مقدار هامش التفضيل أو رسم الاستيراد الفعلي، أيهما أقل.()

17. The main difference between the procurement of goods or construction and the procurement of services was that, in the former, the predominant evaluation criterion was price, while in the latter it was the professional competence and ability of the service provider.
١٧ - واستمر قائلا إن الاختلاف الرئيسي بين اشتراء السلع والانشاءات واشتراء الخدمات هو أن معيار التقييم السائد، في الحالة اﻷولى، هو السعر، في حين أنه في الثاني الكفاءة المهنية والقدرة على تقديم الخدمات.
