1. The author of the communication is Mr. Luis Pascual Estevill, a Spanish national. In his communication of 12 March 2001, he claims to be the victim of a violation by Spain of article 14, paragraph 5, of the International Covenant on Civil and Political Rights.

23. In his communication of 18 August 1998 to the Government, the Special Rapporteur requested information regarding any political prisoners, trade union leaders, human rights advocates and journalists who may still be in detention without charge or trial.

On 6 December 1993, the Government provided the Special Rapporteur with a reply to his communication of 22 September 1994, pointing out that the extension of the scope of the death penalty to the crimes of terrorism and treason was justified on account of the gravity of the phenomenon of terrorism in the country, the need for general prevention and legitimate social defence.

In reply to his communication of 9 February 2000, the Government informed the Special Rapporteur on 26 May 2000 that, concerning the threats received by Arturo Solis, the National Human Rights Commission had begun an investigation into complaints of threats, intimidation and censorship against Mr. Solis.

In his communication of 28 June 1994 the Special Rapporteur informed the Government that he had received new information, according to which the report of the sessions judge, sent to the Supreme Court in June 1993, was to result in prosecution of four officials by the Criminal Bureau of Investigation (CBI) on charges of illegally confining, torturing and possibly pushing Savinder Singh to his death.

On 13 December 2000, the Government informed the Special Rapporteur, in reply to his communication of 3 February 2000, that, with regard to the alleged death threats against Jayalath Jayawardena, the Criminal Investigations Department had inquired into these allegations and had not been able to pursue its investigations in the absence of specific information or evidence with regard to the alleged threatening telephone calls he had received.

On 7 November 1996, in response his communication of 25 July 1995 concerning lawyer Tito Guido Gallegos (see E/CN.4/1996/37, para. 205), the Government informed the Special Rapporteur that Mr. Tito Gallegos had been appointed as a judge of the High Court of the judicial district of Puno by a resolution of the National Council of the Judiciary.
