2.7 The author contends that she no longer has the legal right to undertake judicial proceedings, as Ordinance No. 06-01 on implementation of the Charter for Peace and National Reconciliation, which was adopted by referendum on 29 September 2005, prohibits the taking of any legal action against members of the Algerian defence and security services.

In the Ouaghlissi case, both parties have made numerous references to Ordinance No. 06/01 on the implementation of the Charter for Peace and National Reconciliation; the author considers some of its provisions to be incompatible with the Covenant (see paragraphs 3.7, 3.10 and 5.6 of the Committee's Views), with specific reference to article 2, paragraph 3.
